Moms Demand Automatics To Counter Protest In Denver

A pro-gun group called Moms Demand Automatics is trying to get attention by organizing a counter-protest during Denver’s Jan. 19 Women’s March, according to the group’s Facebook page, which includes likes from Republican State House Minority Leader Patrick Neville of Castle Rock. About 100 people are interested or going to the rally, like former Republican House candidate Grady Nouis.

Gun Crime Rises In CA Despite Gun Laws

Despite all the stringent gun controls a bill filed by Assemblyman Marc Levine (CA-D-10) admits California firearm homicides were up between from 2014 to 2016. The bill says, “Although California has the toughest gun laws in the nation, more effort is necessary to curtail gun violence. The Department of Corrections and Rehabilitation found that from 2014 to 2016 gun homicides increased 18 percent.”

Case Could Reign In Federal Bureaucracies

Recently, there has been a push from some quarters to reconsider Auer deference, Chevron deference, and other aspects of the modern administrative law state, and overturn them as being inherently unconstitutional; specifically, that such deference to bureaucratic decisions violates the required Separation of Powers. 

Were that to happen, the current administrative state would be rocked to its core. While there have been some rumblings from Justice Thomas and others in this regard, there did not appear to be a majority on the Supreme Court interested in potentially unleashing this kind of political earthquake. (Scalia and Kennedy were, at best, squishy on the issue.)

ATF Changes Accessory Review

“Effective immediately, any requests for a determination on how an accessory affects the classification of a firearm under the GCA or NFA must include a firearm with the accessory already installed,” noted ATF. “Except in cases of conditional import determinations, FTISB will not issue a determination on an accessory unless it is attached to the submitted firearm.”

New Dems To Criminalize Private Gun Sales

So Thompson will sponsor legislation requiring a background check before someone may buy a gun from his neighbor, a co-worker to get a background check before buying a gun from a co-worker, and so forth. The bill will go so far as to require a son to get a background check before a father can give him a gun as a gift.

Dick’s Settles Discrimination Lawsuit

Tyler Watson, who claimed that Dick’s violated the state’s discrimination statutes after they refused to sell him a rifle because he was not at least 21 years old, has reportedly reached an agreement to end a pending lawsuit. The terms of the settlement have not been released but the man had sought $1 million in damages.

Third Circuit Upholds Magazine Ban

December 5, 2018. In a 2-1 decision, a panel of the U.S. Court of Appeals for the Third Circuit refused to stop the enforcement of New Jersey’s 10-round magazine ban.

The majority, in an opinion by Judge Shwartz and joined by Judge Greenaway, both appointed by President Obama, held that the ban did not violate the Second Amendment because it reasonably advanced the State’s interest in reducing mass shootings without severely burdening the rights of law-abiding citizens.

NY Rifle Assn. Petitions SCOTUS

In his opinion, New York Rifle & Pistol Association v. City of New York is just such a case. Last week, the plaintiffs filed a brief in support of their petition for writ of certiorari. The complaint involves  the City of New York’s law that prevents gun owners from transporting licensed, locked and unloaded firearms outside the city under any circumstances. They can only use their guns within the five boroughs.

Residents of Boulder, Co., have until December 27 to “certify” their “assault weapons” or remove the firearms from city limits. Those who fail to comply could face fines, jail time, and confiscation and destruction of their firearms, according to the Denver Post.
