Judge Benitez Strikes Down Another CA Gun Law

After years of pinballing around the federal courts, California’s two-decade-old ban on magazines capable of holding more than 10 rounds was once again torpedoed last week. 

Judge Benitez observed: 

One government solution to a few mad men with guns is a law that makes into criminals responsible, law-abiding people wanting larger magazines simply to protect themselves. The history and tradition of the Second Amendment clearly supports state laws against the use or misuse of firearms with unlawful intent, but not the disarmament of the law-abiding citizen. That kind of a solution is an infringement on the Constitutional right of citizens to keep and bear arms. The adoption of the Second Amendment was a freedom calculus decided long ago by our first citizens who cherished individual freedom with its risks more than the subservient security of a British ruler or the smothering safety of domestic lawmakers. The freedom they fought for was worth fighting for then, and that freedom is entitled to be preserved still.

However, some gun dealers noticed that the bill made no mention of magazine components and capitalized on the omission. Dealers throughout the state began selling “parts kits” that contain everything a gun owner needs to assemble their own large-capacity magazine at home. In fact, some gun stores throughout the state now sell magazines only in parts kit form.

Mag Restriction Moves Forward

Enacted in June by Democratic Gov. Phil Murphy after a multi-year push by state lawmakers, the new law reduces the legal maximum capacity of detachable magazines in the state from 15 to 10 rounds. Second Amendment advocates filed an immediate legal challenge to the ban, set to take effect in December, and last week lost the first round of their fight.

California Magazine Ban Blocked

The battle to secure Second Amendment rights is ever-evolving. On Monday, gun owners were dealt a disappointing blow with the Supreme Court’s refusal to review the legal scheme that empowers California counties to effectively ban the bearing of arms (see related article). Yet by Thursday, Second Amendment advocates were cheering a federal court’s opinion blocking enforcement of California’s draconian magazine ban. That opinion, in Duncan v. Becerra, shows what’s possible when a federal judge treats the right to keep and bear arms with the respect deserved by all provisions within the Bill of Rights.

During my 1,000-round test, the AKM PMAG jammed once, when an old round’s bullet dislodged from the shell casing, spilling powder inside the magazine body. I consider this to be a 100 percent success rate, since it was the fault of the round, not the magazine.
