Senator Lankford Introduces Pistol Brace Protection Act

Senator James Lankford (R-OK) is standing up for Oklahomans’ Second Amendment right to own and use pistol braces without burdensome regulation, registration, and taxation. Last week, Lankford introduced the Pistol Brace Protection Act. Lankford’s bill would gut an upcoming final rule by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) by exempting pistol braces from regulation under the National Firearms Act (NFA). The bill eliminates subjective standards that exist in federal law that have allowed ATF to reclassify firearms under the NFA, and guarantees that law-abiding gun owners will not have to register, destroy, or surrender their pistol brace.

Sadly, I have learned that several of our beginning students have done this, even after I have encouraged them to continue their handgun training to the next level. And I am not talking about only the mechanics of shooting, like proper grip, stance, sight alignment, sight picture, trigger control, follow-through, and a few use of deadly force laws. I know I felt that I learned so much after my day-long introductory concealed carry course that I felt that I was ready to defend myself in deadly-force situations and did not need further training on the basic mechanics or other skills.

Pistol Braces And The Heller Case

However, as explained hereHeller erred in at least two respects. First, it misinterpreted the Supreme Court’s decision in U.S. v. Miller (1939). Miller indicated that the right to keep and bear arms includes all arms that “have some reasonable relationship to the preservation or efficiency of a well-regulated militia,” such as those that are “part of the ordinary military equipment” and any others the use of which “could contribute to the common defense.”

Miller also noted that militiamen were historically “expected to appear bearing arms supplied by themselves and of the kind in common use at the time,” so Heller ignored the discussion of military and militia arms and instead concluded that Miller limited the right to arms to those “in common use.”
