Texas Senator Introduces Gun Sanctuary Bill

Sen. Bob Hall (R-Edgewood) filed Senate Bill 378 (SB378) on January 17. The bill would prohibit any state government agency, personnel or public funds from enforcing any federal gun control regulation or law “if the federal statute, order, rule, or regulation or international law imposes a prohibition, restriction, or other regulation, such as a capacity, size, or configuration limitation, that does not exist under the laws of this state.”

Firearms Freedom Act Headed To Supreme Court

The expected decision now clears the way for a battle that could end up in the U.S. Supreme Court over state sovereignty, alleged regulatory overreach, the right to self-defense and even the compact under which Montana became a state.

The Montana Firearms Freedom Act was enacted in Montana and signed into law by Gov. Brian Schweitzer in 2009.

It declares that a firearm made and retained in Montana is not subject to any federal regulation under the power given to Congress in the U.S. Constitution to “regulate commerce … among the states.”

States Introduce Bills Requiring No Permit For CCW

States that have been or are considering bills in current legislative sessions include Colorado, Iowa, Georgia, Kentucky, Maine, New Hampshire, Ohio, Oklahoma, Rhode Island, South Carolina, South Dakota and Virgina, according to the NRA.

South Dakota could be the fifth state to join the ranks of permit-less carry states. Lawmakers last week passed a measure allowing anyone 18 and older with a valid state driver’s license to carry a concealed weapon, as long as they don’t have a background that would otherwise prohibit them from getting a permit. The bill awaits action from Republican Gov. Dennis Daugaard.

SD Gov Signs Firearms Freedom Act into Law

The South Dakota Legislature recently passed SB 89 which declares “exempt from federal regulation any firearm, firearm accessory, or ammunition manufactured and retained in South Dakota.”Now, a little more than a week later, South Dakota Governor Mike Rounds has signed the bill into law.

The bill is the latest of many crafted in states across the country in the last year which re-assert the Tenth Amendment rights of the states which have been carelessly trampled by the federal government for decades.
