How Will Chevron Affect The ATF?

The Supreme Court’s decision to scrap the Chevron Doctrine doesn’t automatically mean that the ATF’s rules on unfinished frames and receivers, pistol stabilizing braces, and who is “engaged in the business” of dealing firearms will be thrown out by the federal judiciary, but it definitely makes it more difficult for the DOJ to defend the rules going forward. 

No longer can the agency reliy on judges giving the agency the benefit of the doubt when it come to interpreting supposedly ambiguous language. Unless the ATF is strictly adhering to the underlying statute when crafting its rules (which has not been the case in recent years) the odds are good that the rule will fall

Army National Guard Specialist Karoline Stancik, 24, has reportedly racked up over $70,000 in medical debt after being hospitalized for heart complications. She suffered her first heart attack after receiving the Moderna COVID-19 vaccine.

Supreme Court Rahimi Decision More Important With Trump Conviction

I think there’s an incredibly strong change that Trump’s conviction will be thrown out on appeal, but that could still be years away. In the meantime, the Supreme Court is probably Trump’s best bet to keep his Second Amendment rights intact, and the Court’s impeding decision in U.S. v. Rahimi provides a perfect vehicle for the justices to give Trump and others convicted of non-violent felonies relief from current federal law. 

In Rahimi, the justices are expected to decide whether someone subject to a domestic violence restraining order can be prohibited from possessing or purchasing a firearm. We don’t know how the Court will rule, but it’s certainly not out of the question that a majority will conclude that Zachey Rahimi and others in similar circumstances can be barred from owning a gun; not solely because of a domestic violence restraining order, but based on a particularized finding of “dangerousness”.

Biden Has Tyrannical Plans For Guns In Second Term

President Biden specifically took aim at re-enacting the failed 1994 Assault Weapons Ban, that even the Centers for Disease Control and Prevention admitted had no effect on crime reduction. He reiterated his disproven claims about “cannon control” and again placed himself as the pre-eminent Second Amendment authority, despite the U.S. Supreme Court clearly establishing the Second Amendment as a right of individual Americans.

Commerce Department Bans Firearm Exports

On April 26, the BIS published an Interim Final Rule that cements the supposed 90-day firearm export “pause” (it has been in effect for 180 days already) into permanent policy while also creating additional regulatory burdens.

In response to the announcement, the National Shooting Sports Foundation (NSSF) said the rule entrenches the Biden Administration’s “whole of government” attack and “is intended to hobble the firearm industry’s ability to compete in the international market under the false pretense of advancing U.S. national security.”

Gun Companies Want Supreme Court To Toss Mexican Lawsuit

ATF Stats Prove “Universal” Background Checks Won’t Work

“Universal” background checks are “universal” in name only and don’t stop criminals from stealing firearms, getting them on the black market, or getting them from straw purchasers. On April 8, ATF published a report on the agency’s firearm trafficking investigations. The “trafficking channel” for roughly two-thirds of the reported cases (65-percent) were “trafficking in firearms by a straw purchaser or straw purchasing ring,” “trafficking in firearms stolen from an FFL,” or “trafficking in firearms stolen from private persons.” For those unfamiliar with the term, “straw purchasing” is when a person buys a firearm, lying on ATF Form 4473 and undergoing a background check, on behalf of a person prohibited from possessing firearms.
