NY Gun Case Headed To Supremes

It has been 11 years since a 5–4 majority, in District of Columbia v. Heller, announced that the Second Amendment protects an individual right to possess handguns in the home for purposes of self-defense. It has been nine years since the same majority held in McDonald v. City of Chicago that an identical handgun-possession right is “incorporated†by the due-process clause of the Fourteenth Amendment (which means it applies to states—and cities—as well as to the federal government). The Court in Heller indicated that it was deciding only a narrow question. Justice Antonin Scalia’s opinion cautioned that “nothing in our opinion should be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms.â€
NY Rifle Assn. Petitions SCOTUS

In his opinion, New York Rifle & Pistol Association v. City of New York is just such a case. Last week, the plaintiffs filed a brief in support of their petition for writ of certiorari. The complaint involves the City of New York’s law that prevents gun owners from transporting licensed, locked and unloaded firearms outside the city under any circumstances. They can only use their guns within the five boroughs.
Gov. Cuomo Criticized For Anti-NRA Stance

In April of this year, though, state regulators told insurers and banks they oversee to look at their relationships with gun rights groups. They warned of “reputational risks†in their “dealings†with the NRA.
“Nice little business you have here,†the state seemed to be saying to banks and insurers. “It’d be a shame if something happened to it.†The state has left little doubt that it was loaded for bear.
Hornandy Shrugs, Stops Selling To New York

Steve Hornady, the company’s president of manufacturing, announced on social media on Friday that the ammo maker will halt sales of their products to Cuomo’s state government or agencies in the Empire State. The move comes after an order directed by Cuomo earlier last month that cautioned banks, insurance companies and lenders against involvement with the National Rifle Association and similar organizations. Slamming the Governor’s move as one of the most “despicable acts ever perpetrated by any state,†Hornady closed the doors to the state.
Parts of NY SAFE Act Repealed

The Cuomo administration’s director of state operations, James Malatras, has signed a memorandum of understanding with State Senate Majority Leader John Flanagan to undo certain aspects of the New York SAFE Act gun control law, though the major changes affect provisions of the law that were never implemented and that pertain to ammunition sales.
Curiously, the memorandum of agreement does not contain the governor’s name, nor that of Assembly Speaker Carl Heastie. But State Senate Republicans said the effect of the memorandum signed by the State Senate and the Cuomo administration effectively blocks implementation of a couple of SAFE Act provisions.
NY SAFE Act Registration Numbers Indicate Mass Non-compliance

Since New York’s SAFE Act gun control law went into effect in January 2013, a total of 23,847 people have applied to register their newly defined assault-style weapons with theState Police.
Those individuals have registered a total of 44,485Â weapons.
New York State has a population of just under 20 million.
NY SAFE Act Kills Business and Jobs

Jackson Guns and Ammo in Henrietta has closed up shop, and owner Kordell Jackson said that New York’s SAFE Act is to blame.
“We were struggling with all the rules and regulations, the New York SAFE Act as well as the New York State payroll taxes, the state taxes, all these taxes,” Jackson said. “You can’t stay in business with all this going on.
Jackson closed up shop Jan. 17. Â He says the decision was difficult. Â After spending five to six months looking for ways to keep his business viable, Jackson said closing made the most sense.
NY Sheriff Tells Citizens To Throw Pistol Permits In The Trash

Three counties—Fulton, Albany, and Schenectady— were chosen in January to take part in the pilot program for pistol permit renewals. Five hundred “invitations,†as the state government dubbed them, are being sent to residents in each of the counties.
“I’m asking everybody who gets these invitations to throw them into the garbage—that’s where they belong,â€Â Fulton County Sheriff Thomas Lorey said at a meeting with Second Amendment supporters.

Although the Cold War ended over two decades ago, a lawsuit filed December 17 in U.S. District Court in Rochester, NY alleges that such heavy-handed police-state tactics are presently being employed in Andrew Cuomo’s New York.  The suit, filed by attorney Paloma Capanna on behalf of plaintiff Donald Montgomery, alleges that the New York State Police ordered the permanent confiscation of Mr. Montgomery’s registered handguns after he sought treatment for insomnia.  The confiscation was ordered under Cuomo’s “SAFE Act†gun-control law.
Buffalo PD Searches Obituaries For Gun Permit Holders

Buffalo Police say they’re determined to get more guns off the streets and now they’re checking to see whether pistol permit holders have passed away and what happened to their gun or guns.
“We recently started a program where we’re cross referencing all the pistol permit holders with the death records, and we’re sending people out to collect the guns whenever possible so that they don’t end up in the wrong hands,” said Police Commissioner Daniel Derrenda.” Because at times they lay out there and the family is not aware of them and they end up just out on the street.”

This is what happens when you give the government power over you. Police officers like this disgrace the profession. Police are there to serve the citizens. The citizens are not the enemy.
P.S. Note to cops everywhere: Act as though you are being filmed, because you are.
Update:Â The officer has been arrested, resigned and is now facing assault charges.
NY State Confiscating Guns

We learned of another incident from a post on NewYorkFirearms.com. A Nassau County man answered his front door to see a swarm of cops. He was told that the police were there to check his firearm’s serial numbers. Under New York law, the police have the authority to verify that the serial numbers registered with the State are correct. That is one of the conditions of owning a firearm. However, in this particular incident, Police entered the home without a warrant.
It was only after the safe was opened that the police informed the homeowner that this wasn’t a routine inspection… it was a confiscation order. After registering his firearms with the state, the police realized that the man had been found guilty of a misdemeanor charge FIFTEEN years ago. Not only was it a misdemeanor, but it might as well have been a lifetime ago!

“It’s basically an AR-15 without the features,” said James Tresmond, a western New York lawyer representing H&H Firearms, a Lackawanna gun shop that’s seeking to sell such a rifle.”
Thanks to modifications by a Texas-based machine shop, the stripped-down rifle has an adapter that connects the spot where the grip would go to the stock, or portion of the rifle that the shooter braces against her shoulder.
NRA Membership in New York Almost Doubles

Tom King, president of the New York State Rifle & Pistol Association, said the NRA headquarters in Washington recently informed him his state affiliate has now surpassed Texas and California to become the largest state NRA chapter in the nation.
Remington, Khar and ATI Bail on New York
All three gun companies are in the process of leaving New York state because of the “SAFE Act” and taking their tax dollars with them.

“It is a law forced on rural New Yorkers by a liberal elite who opposes the principles of the U.S. Constitution,†Hempel said by email. “The majority of the state wants a hands-off, non-intrusive government, which does not interfere with their right to bear arms or crush business with harmful regulation.â€
