The too-long-didn’t-watch answer is no. If police officers are on your private property, that changes things. Cops are trained on the requirement for reasonable suspicion – to develop some reasonable suspicion they can articulate, even if total B.S., and then that entitles them to forcibly demand identification from whomever they deem a suspect. That is generally how things work in public places – but not on private property, especially a home. 

According to the 1980 Supreme Court opinion in Payton v. New York, in order to legally arrest someone in a home, rather than in a public place, absent consent or exigent circumstances, police officers must have a warrant.

Troubled Times For Policing

As turmoil mounts around Black Lives Matter agitation in American cities, more and more law-enforcement officers realize that in just about any encounter with black suspects, they risk being thrown to the wolves by craven local prosecutors, mayors, or police administrators, no matter how right or blameless they may be in the actions they take under pressure.

And the next time they see that cluster of surly young males hanging out on the corner, they may decide to just drive on by. After all, they can’t get suspended, fired, or indicted if they wait to take the report on whatever mayhem those suspects might commit.

Cop Killed By Released Gang Member

A gang member who was recently freed from jail killed his cousin and stole his car Monday then shot and killed a California police officer and wounded his partner before being wounded himself, authorities said.

Whittier Officer Keith Lane Boyer died and Officer Patrick Hazell was wounded when they answered a report of a traffic accident in the eastern Los Angeles County suburb.

California Cops Against Prop. 63

The $3.5 million referendum will end grandfathering of magazines capable of holding more than 10 rounds, require relinquishment of weapons by those prohibited by the state from legal possession and mandatory reporting of lost or stolen guns. In addition, it would require background checks prior to all ammunition sales – a first for any state.

It is this latter facet that drew particular concern from the group of California’s municipal police chiefs, led by Ventura Police Chief Ken Corney.

Citizen Arrested For Taping Cops Serving Warrant

“Clearly, when police officers cease to look and act like civil servants or peace officers but instead look and act like soldiers occupying a hostile territory, it alters their perception of ‘we the people.’ However, those who founded this country believed that we were the masters and that those whose salaries we pay with our hard-earned tax dollars are our servants,” Whitehead said.

“If daring to question, challenge or even hesitate when a cop issues an order can get you charged with resisting arrest or disorderly conduct, you’re not the master in a master-servant relationship. If fact, you’re not even the servant,” he said.

LEOs Oppose Gun Control Measures

“Sheriffs have a constitutional duty to refuse to comply with such ordinances,” said Richard Mack, president of the Constitutional Sheriffs and Peace Officers Association. “We’re seeing sheriffs in New York oppose the Safe Act and Gov. Cop Fired For Beard Length

A Hasidic Jewish NYPD cadet said he plans to sue the agency, after he was dismissed because he refused to trim his beard.

This comes on the heels of news that the D.C. police are now allowing sikhs to join the force with full beards and turbans.
