Facebook and the 1st Amendment: When a government entity exerts dominion over a particular space
and then designates that particular space as a public forum they cannot arbitrarily violate people’s right
to free speech in that space.
Facebook is a private entity and therefore they can arbitrarily censor if they so choose.
An individual user of Facebook is a private person and can arbitrarily censor their own page if
they so choose.
A government entity that uses tax dollars to set up and maintain a Facebook page as a
designated public forum cannot use more tax dollars to then violate the 1st amendment rights of
speakers in that designated public forum through arbitrary censorship.
As Election Day nears, 594’s opponents are ramping up the use of scare tactics. But contrary to what they would like voters to believe, 594 doesn’t infringe on Second Amendment rights. 594 doesn’t change anything about our right to own a gun for self-defense, hunting, range shooting, or competitions—and it certainly doesn’t mean that handing your gun to your friend to try at the range makes you a criminal. But it will make it harder for criminals to obtain guns. That’s why a majority of Washington gun owners support Initiative 594.
The 10-employee company based in Capitola, California, said it was deploying the technology on a trial basis. The first takers have been the Santa Cruz County Sheriff’s Department in California and the Carrollton Police Department in Texas.
“By connecting the firearm to the cloud, we give departments a technology that enhances officer safety, improves operational efficiency, and builds community trust,” Jim Schaff, a Yardarm vice president, said.
While backers of billionaire-funded Initiative 594 are planning one more rally this Saturday – using the Marysville-Pilchuck school shooting as something of a campaign prop – another county sheriff has joined 26 of his colleagues to oppose the measure, making the count more than two-thirds of the elected sheriffs against the measure.
A majority of Washington State’s 39 sheriffs have come out in opposition to anti-gun Washington State Ballot Initiative 594.  The sheriffs oppose I-594 because it will not make anyone safer, will strain scarce law enforcement resources, will criminalize the lawful behavior of millions of law-abiding gun owners in Washington and will be unenforceable. Instead, I-594 would vastly expand the state’s handgun registry and force law-abiding gun owners to pay fees and get the government’s permission to sell or even loan a firearm to a friend or family member.
To date, 27 of the 39 sheriffs have publicly opposed I-594.
When Marty Flynn and Ryan Bizarro were on their way back to the Pennsylvania State Capitol late on a Tuesday evening, they were brazenly attacked by four young teenagers.
Flynn, a former prison guard and expert level martial artist, wasted no time in drawing his concealed handgun and opening fire on the attackers. Flynn exchanged fire with his assailants, who then fled after encountering resistance.
An Idaho woman who is barred from carrying a functional firearm for self-defense when she visits federal recreational facilities prevailed today with the ruling of an Idaho federal district court that the federal government ban on firearms violates the Second Amendment. Elizabeth E. Morris of Nez Perce County is licensed to carry a concealed weapon, regularly carries a concealed weapon, and often seeks to recreate on lands managed by the U.S. Army Corps of Engineers. Because Corps of Engineers regulations ban functional firearms, even while camped in tents, Ms. Morris is subject to criminal prosecution if she attempts to exercise her Second Amendment rights. Alan C. Baker, a firearms instructor and a resident of Idaho’s Latah County, is a co-plaintiff in the suit, which was filed in August 2013 in Idaho federal district court. The Corps of Engineers did not respond to requests from attorneys for Ms. Morris and Mr. Baker, Mountain States Legal Foundation (MSLF), seeking an exemption from its firearm ban, a ban that has not changed since the landmarkHeller ruling.
As a law enforcement officer, I know this is completely un-enforceable. Unless a cop is hiding in your living room when you make the sale, gift or loan, no one will ever know it happened and it won’t help solve the problem. Sadly, both sides have wasted multi-millions of dollars on this un-workable Initiative.
“The lawsuit alleges that the websites negligently supplied Holmes with the arsenal he used to kill 12 people and wound at least 58 others by failing to use any screening mechanism to determine his identity or intent for the products,†the Brady Center said in a media release, Fox-affiliated KDVR reported.
The MSNBC poll asking whether Kroger shoppers should be allowed to carry handguns was coming in with 85 percent in favor and only 15 percent opposed. A CNBC poll on the Panera Bread decision was running at 84 percent support forgun rights and 11 percent against. An MSNBC poll on the Panera Bread request was also coming in at 75 percent in favor of armed customers, and 25 percent against guns.
A SWAT team raided co-owner Joe Palumbo’s Albion Gun Shop without a warrant. They were acting on orders from the Narcotics Enforcement Unit, who asked the shop to hand over a customer list so they could determine how many people had purchased New York SAFE Act compliant rifles. The gun owner was forced to present approximately 170 sales records. Under the state’s anti-gun law, this intrusion was completely legal.
Critics claim that exchanges such as these prove that the SAFE Act is arbitrary and confusing:
“The New York S.A.F.E. Act is being enforced arbitrarily on a case by case basis,†Tresmond said. “That amounts to unconstitutional vagueness under the Supreme Court’s Morales standard, and the law should be enjoined for that reason alone.â€
The New York Times concedes that the term “assault weapon” was made up and that the ban in the ’90s didn’t work.
But in the 10 years since the previous ban lapsed, even gun control advocates acknowledge a larger truth: The law that barred the sale of assault weapons from 1994 to 2004 made little difference.
It turns out that big, scary military rifles don’t kill the vast majority of the 11,000 Americans murdered with guns each year. Little handguns do.
It was much the same in the early 1990s when Democrats created and then banned a category of guns they called “assault weapons.†America was then suffering from a spike in gun crime and it seemed like a problem threatening everyone. Gun murders each year had been climbing: 11,000, then 13,000, then 17,000.
