Michigan AG Says No Law Needed To Ban Gun On Capitol

After armed protestors poured into the state capitol building in Lansing, Michigan last week, several lawmakers responded by saying they wanted to see guns banned from the capitol complex. Now the state’s Attorney General has weighed in, telling lawmakers that the state’s Capitol Commission has the authority to enact a ban, without the need for the Legislature to approve any changes.

Protest Critic Gets It Half Right

History has a funny way of coming back around. Both the Black Panthers and these protestors were exercising their First Amendment right to peaceably assemble. Both were exercising their Second Amendment right to bear arms — except only the Panthers were doing so in a way that matched the issue being protested. The Michigan demonstrators were using their rifles, apparently, to stop a pandemic.

With emergency orders ranging from a ban on motorized watercraft to a prohibition on the sale of infant and child car seats (both are apparently non-essential), the Wolverine State’s chief executive has ticked off plenty of everyday people who don’t normally concern themselves with politics.

College Student Arrested For Posting AR Picture

A 20-year-old college student at Lake Superior State University in Michigan has been jailed for 3-months awaiting trial on terrorism related charges. His offense? According to multiple sources, Lucas Gerhard was arrested for posting a picture of his new AR-15 online with the caption, “this outta make snowflakes melt”. His post also included this, “and I mean snow.”

In Detroit Citizens Shoot Back, Murder At 50 yr Low

Detroit’s population in 2018 was listed as 672,662. The number of murders in Detroit were listed as 261. This equates to a homicide rate of 38.8 per 100,000 population. It is the second highest city in the nation. However, the number of murders are considerably lower than they were in 2012, just before Chief Craig took over. The numbers of murders are the lowest in 50 years. The population of Detroit has dropped; thus the rate of murders is still high. The rate was 55.2 per 100,000 in 2012. In 2012, the interim police chief, Chester Logan, blamed the homicide rate on guns.

Gun-free Zone Liability Law

State Rep. Gary Eisen, R-St. Clair Township, introduced House Bill 4975, which would revoke governmental immunity from lawsuits arising from injuries sustained on government property where guns are banned. Eisen is also the sponsor of House Bill 4976, which would make a government, business or individual that designates a property a gun-free zone responsible for the safety of individuals who enter it.

On Tuesday, the Michigan Court of Appeals unanimously reversed Ra’s convictions, arguing in its decision that her trial judge failed to appropriately instruct Ra’s jury on her self-defense claim, and that said failure likely affected the outcome of her case.

Students Arrested For Handing Out Constitutions

Kellogg Community College students Brandon Withers and Michelle Gregoire were arrested Sept. 20, 2015, in Battle Creek after they refused to stop handing out copies of the U.S. Constitution on campus. Officials cited the school’s Solicitation Policy, which requires permission for such behavior, before having the Young Americans for Liberty members and a friend arrested.

Detroit CHL Holder Charged With Recklessness For Shooting At Car Thief

Forty-six-year-old Tatiana Duva-Rodriguez heard screams in a Home Depot parking lot and saw a man jump into a car with stolen goods. Duva-Rodriguez pulled out her pistol and fired off two rounds into the escape car’s tires, flattening one of them.

From The Washington Post:

Tatiana Duva-Rodriguez thought she was doing the right thing when she pulled out her pistol and fired at a pair of shoplifters as they fled from a Home Depot near Detroit.

She wasn’t, at least in the eyes of the law.

On Wednesday, a Michigan judge sentenced Duva-Rodriguez to 18 months of probation and stripped the 46-year-old of her concealed gun permit.

Court Rules in Favor of Gun Owner Who Was Committed 28 Years Ago

In the first legal ruling of its type, a federal appeals court in Cincinnati on Thursday deemed unconstitutional a federal law that kept a Michigan man who was briefly committed to a mental institution decades ago from owning a gun.

A three-judge panel of the Sixth U.S. Circuit Court of Appeals unanimously ruled that the federal ban on gun ownership for anyone who has been “adjudicated as a mental defective or who has been committed to a mental institution” violated the Second Amendment rights of Clifford Charles Tyler, a 73-year-old Hillsdale County man.
