An Argument For National Gun Reciprocity

Two New Hampshire men charged in separate incidents with unlawful possession of a gun have challenged Massachusetts firearm law. Dean Donnell Jr. and Phillip Marquis are both legal gun owners and residents of New Hampshire, a state that issues carry permits for purposes of reciprocity but otherwise observes constitutional carry, meaning that no license is necessary to open or conceal carry within the state. Attorneys for the men argue that Massachusetts felony charges, under the state’s strict firearm laws, are a violation of their Constitutional rights.
“Massachusetts can’t be less protective than the Second Amendment,” argued Hayne Barnwell attorney for Phillip Marquis.
Congressman Massie Introduces National Constitutional Carry

The National Constitutional Carry Act (HR 9534) would remove permitting requirements for Americans to carry firearms nationwide. Most US states do not have permitting requirements to carry a gun. The bill will also remove the states’ and territories’ ability to prevent Americans who are not a prohibited person from carrying guns in public. Any regulations passed by the states to restrict one’s ability to carry a firearm would not have the force of law. Rep. Massie believes that an American shouldn’t have to seek a permission slip from the government to exercise an inalienable right.
Carrying In A National Park Is Still Confusing

Sadly, visitors still face a bit of a minefield. While you can lawfully carry in a national park according to the laws of the state the park is in, “federal facilities” within the parks are still off limits. This basically means any building in which NPS personnel work, so the visitor center, many bathrooms and showers, and even some hotels are off limits. Worse, the National Park Service has stretched the reasonable definition of “building” to include natural structures like the caves at Carlsbad Caverns.
No Reciprocity Is Hurting Truck Drivers

Thousands of truck drivers are breaking the law by carrying firearms across state lines, but is the problem the truck driver or the laws?

New NICS Law Could Be Opening For More Gun Control

“Enforce the law” has been a mantra for squish Republicans. Â So, you may ask, what’s wrong with making sure every single eligible name reaches NICS?
The answer is that the “dirty little secret” of NICS is that the prohibited persons law (18 U.S.C. 922(g)) and its interpretation under a 2007 law and its regulations are so perverse that, if actually enforced to the letter, they would ban guns from millions of additional law-abiding Americans.
If this doesn’t bother you, how about 18 U.S.C. 922(g)(3)’s ban on marijuana smokers? Â Under Cornyn-Schumer, states would be required to turn over to the FBI medical marijuana lists, and lists of persons in diversion and medical treatment programs. Â Incidentally, the FBI still regards all of these people as federal felons.
Or what about the roughly 13% of all Brady Law denials occurring under 18 U.S.C. 922(g)(2) — a scary “fugitive” category which normally means that the person had an unpaid traffic ticket while on vacation? Â This is actually happening now, and is a major issue. Â Are we going to turn in the names of all “renegade parkers” who haven’t paid their fines?
National Concealed Carry and the Second Amendment

While I’d be thrilled that I’d no longer be disarmed and treated like a second class citizen when I visit my friends in the Northeast (other than needing to acquire some “NY legal†downloaded magazines, and another few boxes of Federal Guard Dog 9mm to get around New Jersey’s ignorant ban on hollowpoint ammunition), I frankly am opposed to federal gun laws.
I don’t want more federal gun laws, but instead want the federal gun laws that exist (the National Firearms Act of 1934, Gun Control Act of 1968, etc) repealed or declared unconstitutional.
National Concealed Carry Reciprocity Bill Submitted To Congress

On behalf of its five-million members, the National Rifle Association’s Institute for Legislative Action (NRA-ILA) applauded the introduction of H.R. 38, The Concealed Carry Reciprocity Act of 2017, authored by Congressman Richard Hudson (NC-8). This legislation would eliminate the confusing patchwork of state carry laws by allowing individuals who possess concealed carry permits from their home state or who are not prohibited from carrying concealed in their home state to exercise those rights in any other state that does not prohibit concealed carry.
