Judge Throws Out SAFE Act Violation on 4th Amendment Grounds

“In observing the magazine, I did notice there were at least 10 rounds in the magazine,†Barrancotta testified. He then emptied the magazine.
“I did count rounds just to confirm our reasonable suspicion that there were more than 10,†Piedmont said.
Tresmond said, “Once the magazine is removed from the firearm, the firearm cannot fire. At that point in time, the search of the firearm should have ceased. But the officers went further. … It was a search without a warrant.â€

The Gun Owners Action League of Massachusetts said the technology championed by Markey is often flawed and smart guns ‘‘only work correctly in the movies.’’
‘‘No technology should stand between a lawful gun owner using his/her firearm,’’ the group said in a written statement. ‘‘We also find it more than disingenuous that a senator with very little knowledge of firearms, who has worked to stifle the Second Amendment, would offer mandated technology that gun owners have not asked for, nor supported.’’
Tampa Bank Manager Fired For Concealed Carry

The 37-year-old Tampa resident is a single mother of three children and said she carries the gun for safety.
Ros has filed a lawsuit in circuit court against Wells Fargo Bank, which she said fired her last year from her job as manager at the bank’s Oldsmar branch. Her lawsuit says the firing violated her constitutional right to carry arms and asks for monetary damages and attorney fees.
Supreme Court Refuses To Hear Case On Gun Rights Of 18 to 20-year-olds

NYC Gun Fee “Violates Equal Protection”

The lawsuit challenges New York City’s $340 fee for a three-year handgun license, which is the highest such fee imposed for a gun possession license anywhere in the United States. SAF founder and Executive Vice President Alan Gottlieb noted that the fee anywhere else in the entire state of New York is $10, but the city is exempted from that law, The city’s higher fee, he said, “discourages city residents from exercising their civil rights while violating the Equal Protection Clause of the Fourteenth Amendment.â€
Supreme Court May Take Up Several Gun Cases In Next Term

…a federal appeals court panel’s divided ruling last week in a California case makes it more likely that the question of guns outside the home will be heading to the high court soon.
To date, the biggest split from that trend involved an Illinois law that was much more restrictive than those in other states. Its ban on carrying concealed weapons in nearly all circumstances was struck down by a 7th Circuit appeals court panel. Rather than appealing to the Supreme Court, however, the state amended the law to allow for public possession, with restrictions.
Supreme Court Needs To Clarify Second Amendment

While Heller clarified that the Second Amendment secures an individual right, the ruling left many questions about the scope of that right unanswered. Since then, several courts have made clear that they plan to take only as much from Heller as they absolutely have to.
Since Heller struck down D.C.’s ban on functional firearms in the home, recalcitrant courts pretend that the Second Amendment is limited to the right to keep arms and that legislatures can for very little (or no) reason to ignore the right to bear them outside the home.
Colorado Bill Would Repeal 1969 Rifle Law

The bill would undo a 1969 law that says Coloradans may purchase, but not take possession of, a shotgun or rifle unless they buy it in Colorado or a contiguous state.
Judge Upholds San Francisco Magazine Ban

“The judge’s ruling completely flies in the face of what the Heller case says, “said Michel. “The Heller case said that the handguns at issue were protected because they were commonly used by law abiding citizens for self-defense. The judge in San Francisco seized on the word ‘used’ to say that magazines were holding more than ten rounds were hardly ever used for self-defense i.e. people never fired more than ten rounds, they weren’t protected.â€
Minnesota Cops Sue NFL Over Gun Ban

Minnesota’s largest police group and police union are suing the NFL and the Vikings, claiming the league’s new ban on off-duty cops carrying their guns to games is illegal.
The Minnesota law that allows businesses to bar weapons specifically exempts “active licensed” peace officers, and state law trumps NFL rules, the lawsuit says.
Idaho to Repeal CCW Exemption for Politicians
