The 2nd and 14th Amendment Working Together

Every now and then a case, a law comes into focus to remind us just how far we remain from the dream of equal protection under the law. Such a case appears this week in the State of California where the betters have moved Senate Bill 707 to Governor Jerry Brown’s desk for consideration.
SB 707 is a gun control bill. It is part of a larger strategy of zero tolerance gun control measures with the real aim to trip people up in ways that even the smallest mistake causes them to lose their gun rights. SB 707 adds a new tripwire to the Gun Free Zone laws that surround 1,000 feet around every school in California threatening everyone, even those with a dire need or legal permit, from being within these zones with a gun. Everyone that is, except for the one lobby Sacramento needed to support this law, retired police officers. Even though they are no longer law enforcement officers and do not have any police powers, they will be granted a privilege no other citizen will have in the State of California. Indeed, there are lobbyists that seem to believe that retired police officers are not subject to living among their lowly fellow citizens as equals under the 14th Amendment; that they are better, exempt; that they are not “little people”.
Study Says More Armed Civilians Equals Less Crime

Overall, the study notes, between 2007 and 2014, as permit numbers have increased, “murder rates have fallen from 5.6 to 4.2 (preliminary estimates) per 100,000. This represents a 25% drop in the murder rate at the same time that the percentage of the adult population with permits soared by 156%. Overall violent crime also fell by 25 percent over that period of time.â€
No Guns in Uber Cars?

Uber has forbidden all its supposed free-agent drivers to carry guns or to pick up anyone with a gun. So Uber gets to tell you how you may protect yourself (prayer, maybe?) and restricts you from carrying a whole class of passengers.
In concealed carry states no one is supposed to know/see that you have a gun so how would this be enforced? Quick answer: it can’t. It won’t be long now before criminals start targeting Uber cars to rob driver and passenger.

Open Carry and College Carry Move Forward In Texas

If passed, Texas would be one of the last states to allow some form of open carry, but would be the largest by population to do so.
The session’s other gun-rights bill, allowing concealed handguns in college classrooms, lurched toward resolution with an agreement to let schools create “reasonable†gun-free zones. The last point to resolve is whether to force private universities to allow weapons.
Concealed Carry And Legal Non-residents

A federal district court in North Carolina held Friday that North Carolina may not discriminate against permanent resident noncitizens in issuing licenses to carry concealed guns. (Messmer v. Harrison.) The U.S. Supreme Court’s D.C. v. Heller decision said that general bans on concealed carry of guns are constitutional, because the have been around in many states starting with the early 1800s. But the Supreme Court held that state laws discriminating against noncitizens — even as to activities that aren’t themselves constitutional rights — usually violate the Equal Protection Clause. That seems to be the court’s rationale in this case.
Gun Issue Creating “Two Americas”

At the Wall Street Journal she writes that it no longer makes sense in the United States to talk about national gun policy, but instead to recognize widely divergent trends at the state level that are taking Americans in different political, cultural, and technological directions.

Tampa Bay Times Anti-gun Editorial
It’s been a banner session in Tallahassee for gun zealots and the National Rifle Association and a terrible one for common sense and public safety. In the past weeks, the Senate passed a bill allowing gun owners to carry their weapons in public during a declared state of emergency. It also moved closer to allowing guns on college campuses. The House, meanwhile, killed a bill that would have barred backyard shooting ranges. With the state and the Tampa Bay area awash in gun violence, it was a stunning display of this Legislature’s blatant disregard for public safety.
In an attempt to prove this premise, they touch on the “contrived†arguments for campus carry, arguments that rest on the idea of armed women stopping “murderers and rapists.â€
The problem with this line of thinking is that conservatives believe women are as capable of stopping murderers and rapists as men are, given one important tool…a gun. Conservatives do not agree with the Times, Salon, Shannon Watts, Moms Demand Action, Everytown for Gun Safety, and others who [are paid to] or pretend the idea of arming women is foolish.
Second Amendment Enforcement Act

This week, U.S. Senator Marco Rubio (R-Fla.) and U.S. Representative Jim Jordan (R-Ohio) introduced “The Second Amendment Enforcement Act of 2015†in the U.S. Senate and House respectively. These bills would restore the fundamental individual right for law-abiding D.C. residents to Keep and Bear Arms to defend themselves in accordance with the law. This bill would also conform D.C. law to federal laws in regards to governing firearms commerce, while also allowing D.C. residents to purchase firearms from licensed dealers in VA and MD, without the current hassle of D.C.’s onerous firearm registration system. The D.C. permitting system would also become streamlined, allowing for more law-abiding D.C. residents to legally obtain a permit and carry concealed firearms for self-defense.
Texas Senator Cornyn Introduces Federal Reciprocity Bill

Think of it like this – if you have a driver’s license in your home state, you can use that anywhere in the country, however, you still have to follow any state driving laws in other states. Just because your state allows right turns on red doesn’t mean another state does too.

U.S. Sen. John Cornyn (R-TX) today introduced the bipartisan Constitutional Concealed Carry Reciprocity Act of 2015, which would allow individuals with concealed carry privileges in their home state to exercise those rights in any other state that also has concealed carry laws, while abiding by that state’s concealed carry laws. Senators Joe Manchin (D-WV), John Thune (R-SD) and David Vitter (R-LA) are the lead cosponsors of the bill.
First Carry Permits in D.C.

The District of Columbia has issued its first concealed handgun carry permits. As of January 26, there are eight civilians who can legally carry a firearm in the nation’s capital. Currently, more permit applicants have been denied than approved.
Maryland’s War on Guns

Wendy Davis Only Said She Supported Gun Rights to Get Elected

“There is one thing that I would do differently in that campaign, and it relates to the position that I took on open-carry,†Davis told the San Antonio Express-News on Monday. “I made a quick decision on that with a very short conversation with my team and it wasn’t really in keeping with what I think is the correct position on that issue.â€
Davis added that she does support “people’s right to own and to bear arms in appropriate situations,†but fears that open carry would be used “to intimidate and cause fear.â€
California’s “Good Cause” Requirement Struck Down

The ruling means that California will effectively become “shall issue,†and must issue concealed carry permits to otherwise qualified applicants who had previously been stopped by the unevenly applied “good cause†provisions.
Gun Bills To Consider In The Next Two Years

Now that Republicans are in full control of Congress, there are a couple of firearms related bills that I would like to see debated. The first would fix the Firearms Owners Protection Act of 1986 (FOPA), making it clear henceforth that the law’s “safe passage†provision applies to airports as well as to highways. Earlier in the year, I noted that the states of New York and New Jersey have managed to exempt themselves from FOPA’s remit, thereby preventing Americans who rely upon JFK, LaGuardia, and Newark airports from traveling with their guns.
