Court Upholds DIY Firearms

The case, Vanderstok v. Garland, was brought by the Firearms Policy Coalition (FPC) and challenged the ATF’s decision to reclassify unfinished frames and receivers as firearms. Biden and other anti-gun zealots have railed against Americans building their own guns in the privacy of their own homes. The anti-gun side of the debate has propagandized these items as tools of criminals and has labeled the items as “ghost guns.”
JSD Supply Wants Injunction Against ATF

JSD Supply sued the ATF after the Bureau issued the company a cease-and-desist order demanding that it stop selling parts and kits on its website. The government insisted that selling unfinished firearms frames and parts constituted selling unserialized firearms without a federal firearms license (FFL), even if the customer purchased the items separately. The ATF called this “structuring.”
FPC Attacks ATF Rule As Unlawful

Today, the Department of Justice officially released a notice of proposed rulemaking announcing a new ATF rule which would, among other attacks on firearm owners, builders, and dealers, redefine the terms “receiver†and “frame.†FPC previously issued a statement regarding a leaked, draft version of the new rule in mid-April. ATF Agent Says Most Guns Aren’t “Firearms”
From CNN:
“That part of a firearm which provides housing for the hammer, bolt or breechblock, and firing mechanism, and which is usually threaded at its forward portion to receive the barrel.”
The problem — and this is where O’Kelly comes in — is that he says roughly 60% of the guns in America do not have a single part that falls under that definition. The AR-15, for example, has a split receiver — one upper and one lower. Neither meets the requirement on its own.“For 50 years, ATF has been making this square peg fit in the round hole,” O’Kelly told CNN, “when, in fact, it doesn’t.”
