Confiscation If A Threat To Every American

In the wake of yet another round of mass shootings, these gun confiscation laws—extreme risk protection order (ERPO) laws—may appease the fears of those who believe that fewer guns in the hands of the general populace will make our society safer.

With these red flag gun laws, the stated intention is to disarm individuals who are potential threats… to “stop dangerous people before they act.”

Rubio Proposes Anti Gun Bill

Individuals, the legislation states, do not have to be guilty for the FBI director and the Joint Terrorism Task Force to be alerted when they attempt to purchase or receive a transferred firearm. The U.S. attorney general is also notified and retains the power to stall the process for up to 10 business days and file an emergency petition to halt the gun procedure until a court can rule on it as long as the individual is notified.

Dems Using Covid Emergency To Force New Gun Restrictions

As a condition of passing the COVID-19 Phase 4 legislative relief package, Pelosi and Schumer are preparing to demand their liberal wish-list.
This list could include many items that would be of concern to conservative constitutionalists, generally. But of specific concern to gun owners is the gun control that Pelosi could try to sneak into a COVID-19 relief package — things like Red Flag gun confiscation orders, and more. Our federal lobbyists have been communicating with Senate Republican offices, and right now, it’s too early to tell where the anti-gun Democrat leadership is going to make their big push. Yes, there are anti-gun congressmen who are demanding that Red Flag gun confiscation orders be added to the relief bill. And so Republican Senators need to hear that this would be a non-starter.

Kentucky To Consider Red Flag Laws

On Friday, November 22nd, the Kentucky state Interim Joint Committee on Judiciary will consider so called “red-flag laws.” Though no legislation has been introduced, such laws usually allow for Second Amendment rights to be suspended and firearms seized without due process. Red Flag Laws Hurting Innocents

One thing is certain: Taking away people’s guns based on predictions of what they might do with them raises thorny due process concerns. That’s especially true with laws like Maryland’s, which authorize broad categories of people to seek ERPOs based on scant evidence and effectively put the burden on gun owners to demonstrate that they don’t pose a threat to themselves or others. While the benefits of these laws are mostly speculative, they inevitably deprive law-abiding people of the constitutional right to armed self-defense, even when it is quite unlikely that they would use guns to hurt themselves or anyone else.

Red Flags and Due Process

Senator Lindsey Graham (R-S.C.) promised that under his bill, to get a federal grant, the state red flag laws would have to provide “due process.”  Similarly, President Trump has sought to assure the public that any red flag legislation will provide for “rapid due process.”  When questioned, most congressional Republicans say they will support police seizing guns only if rigorous due process is provided.  Don’t buy it.  Red flag laws violate the Second Amendment, and “due process” is not a magic wand to be waved to make the infringement go away.
