Washington Fines Restaurant For Trying To Make A Living

The fine includes $9,639 for each day Spiffy’s continued to offer indoor dining after L&I employees told them to stop — a confrontation that spurred days of armed protests last week. The fine was issued Monday, in addition to an “order and notice of immediate restraint,” which in layman terms, tells a business that “you have to come under compliance right now,” according to L&I spokesperson Tim Church.

Businesses In Lewis County Stand Up To Washington Gov Inslee

Mossyrock restaurants may continue offering indoor dining this week despite Gov. Jay Inslee’s new sweeping restrictions after the city passed an ordinance in November saying the city “will not recognize” Inslee’s proclamation until “sufficient COVID-19 information and data is presented to the City that establishes a state of emergency exists within the City.”

WA Confiscation Law Unconstitutional

Earlier this year, in a ruling of first impression in Washington State, the Kitsap County District Court decided that the state’s compulsory “firearm surrender” laws violated the Fourth and Fifth Amendments and the analogous provisions in the state constitution. “In our constitutional system of government, individuals have rights that the government and its agents (including courts) must respect. Among those rights are the right to be free from compelled self-incrimination under the Fifth Amendment, the right to be free from unreasonable searches and seizures under the Fourth Amendment, and their counterparts under Washington’s constitution.”

Washington Attacks Gun Owners While Failing To Prosecute Criminals

It evidently doesn’t matter that the two suspects in last month’s fatal fracas could not legally possess, much less carry, firearms. While the state Department of Licensing last Friday advised Ammoland News that there are now 647,233 active CPLs in the state—the highest number of any far western state, except for Utah—suspects William Tolliver and Marquise Latrelle Tolbert don’t have one. They were apprehended after being on the run more than a week, during which time they became examples of a justice system in serious need of repair.

JB Herren On The Shooting In Vancouver, WA

Reliable information can be difficult to find.  Here is an update on the November 26th shooting outside an elementary school in Vancouver, WA.

A husband and father, with a history of domestic violence, shot his estranged wife and her mother as they sat parked outside a Vancouver, WA elementary school, after loading their three children into the car.  The wife was pronounced dead, and her mother was shot three times, but is expected to recover.  All three children witnessed the shooting.  The children were not physically injured.

Judge Says There Should Be A License For 3D Printing Software

This week, Judge Robert A. Lasnik of U.S. District Court for the Western District of Washington, in deciding on motions for summary judgment in that suit, State of Washington et al. v. U.S. Department of State et al., agreed that removing those files from the USML was unlawful based on the APA arguments (though not the 10th Amendment ones), and reversed the federal government’s choice to allow free distribution of the files.
As discussed in Lasnik’s decision, the federal government’s initial reaction to the states’ suit “justified the deregulation of the CAD files [that could help make weapons]…by pointing to a Department of Defense determination that the items ‘do not provide the United States with a critical military or intelligence advantage’ and ‘are already commonly available and not inherently for military end-use.'”

AR Sales Increase Ahead of Washington Gun Law

We’ve talked about Washington’s Initiative 1639 before. It puts a host of new restrictions on gun owners, including requiring a permanent waiver of their HIPAA rights before buying a handgun or semi-automatic rifle.

Ahead of this, Washingtonians are buying up everything they can get their hands on. It will be interesting to watch Washington going forward, as this is in many ways an unprecedented restriction. A number of lawsuits are already winding their way through the courts. This will be worth watching.

Washington Expands Reasons For Taking Guns

Now, the state wants to use ERPOs for more gun owners who, like the man who went to Northwest Hospital in early April, threaten to commit hate-fueled violence. Among a slew of gun violence prevention bills signed by Governor Jay Inslee in early May was an amendment to the current ERPO law that specifies that judges should consider whether a troubled gun owner has been convicted of “malicious harassment,” a category that includes behaviors like burning crosses and defacing property with swastikas. It’s the first hate-specific ERPO law in the country.

Gun Rights Denied Because Of Juvenile Conviction

The Washington State Supreme Court has overturned a lower court order that would have allowed a man convicted of juvenile felonies to get a concealed pistol license.
The court ruled Thursday that a federal prohibition still applies to his juvenile crimes, even though they were later ordered sealed.

Washington Lawmaker Offers Bill To Repeal Gun Law

“Initiative 1639 is unconstitutional in many respects and punishes law-abiding citizens, while doing nothing to keep firearms away from criminals,” said Shea in a written statement.
In its current form, the law represents the most sweeping, comprehensive gun control legislation in any state. It enacts waiting periods and background checks on the purchase of semi-automatic weapons, an increase to the minimum age for purchasing semi-automatic weapons from 18 to 21, storage requirements for firearms, and a class-C felony for any gun owner whose firearm is used by an unlicensed party.

22 Washington Counties Refuse To Enforce Gun Law

The Sheriffs of Washington’s rural counties are increasingly pledging to not enforce the new gun control bill (I-1639) that was passed in November by ballot initiative, citing it as unconstitutional. 22 out of 39 counties make up the latest count, with more expected as the court battles ramp up across the state.
