PA Law Challenged On Due Process

On July 3, 2019, Gun Owners of America (GOA) and its legal arm, Gun Owners Foundation (GOF) — in cooperation with local gun groups — filed an Amici Curiae brief with the United States Court of Appeals for the Third Circuit. The brief is supporting gun owners who had their constitutional right to keep and bear arms violated by Section 302 of the Pennsylvania Mental Health Procedures Act (MHPA).
Ford Forces Dealership To Cancel Gun Promotion

Chatom Ford in Chatom, Ala., released a statement saying, “We were running a promotion celebrating this country’s independence. Ford Motor Company has asked us to stop running the advertisement. They manufacture the products we are franchised to sell, so we are complying with their request.†The small-town dealer added that they “appreciate everyone’s support,†and will honor the promotion up to the point when Ford made them stop it.

CA Bullet Control Faces Legal Challenge

With reported widespread glitches and bugs in California’s new bullet control plan, Second Amendment groups are promising to soon see the state in court. Gov. Gavin Newsom’s Proposition 63, which among other tenets requires a background check on every ammunition sale in California, kicked fully into effect this week and in many cases left a bad taste in the mouths of would-be ammo buyers.
The Associated Press reported long lines at gun stores and confusion about the new regulations along with delays and frustration. One gun owner documented his experience being denied the opportunity to attempt a check even though he had a current California driver’s license and U.S. passport. Such problems, say gun advocates, cues up the new law for a legal challenge.

It’s been an open secret for more than 20 years (since at least the 1990s) that an outside public relations firm, Ackerman McQueen Inc. (around NRA headquarters, commonly called “Ack-Macâ€) enjoyed a favored and protected, if not inviolate, relationship with NRA. The owners of Ack-Mac were close friends and associates of NRA Executive Vice President Wayne LaPierre. He handed them major roles formulating, directing and performing many NRA operations for which Ack-Mac and its associated companies bill NRA millions of dollars annually — in 2017 alone, over $40 million. To ensure their position by enhancing his, Ack-Mac created a persona for LaPierre as NRA’s public face; his strident, increasingly right-wing rhetoric espoused in NRA’s name was shaped and scripted by Ack-Mac. In turn he fended off sporadic calls to reduce Ack-Mac’s penetration of NRA. LaPierre and Ack-Mac became practically indistinguishable.
California Law Banning Under 21 Gun Owners Challenged In Court

Second Amendment right groups sued the state of California Monday over the new law banning the sale of firearms to people under the age of 21.
“Once individuals turn eighteen, they are adults in the eyes of the law,†said John W. Dillon, the Carlsbad attorney representing the groups, the Los Angeles Times reported.

More Calls For Banning ARs

“Allentown has now joined the pantheon no city ever wanted to be in: Cities which have seen mass shooting with someone using an AR-15,†state Rep. Mike Schlossberg said.
The legislation would effectively ban the possession, purchase, transfer, use or manufacture of those weapons in Pennsylvania, with exceptions for military and law enforcement. But it would allow people who owned the weapons prior to the date of enforcement to continue doing so.

Granted, some people misuse guns: In 2011 an estimated 11,101 of 15,953 homicides involved a gun, as did 19,766 of 38,285 suicides, as did 851 of 122,777 accidental deaths. But such misuse is not grounds for outlawing guns. Legitimate laws—those that protect individual rights—do not punish law-abiding individuals for the crimes of others, nor do they restrain the psychologically healthy because of the suicidal, nor do they restrain the responsible because of the irresponsible.
Liberal Justices Find Gun Law “Unconstitutionally Vague”

Under the law, the men could have faced a mandatory minimum sentence of five years, with it rising to seven years if the gun is brandished and to 10 if it’s fired. Other minimum sentences can also be imposed based on the type of firearm used during the alleged offense.
“In our constitutional order, a vague law is no law at all,” Gorsuch wrote. “Only the people’s elected representatives in Congress have the power to write new federal criminal laws. And when Congress exercises that power, it has to write statutes that given ordinary people fair warning about what the law demands of them.”

Suppressor Ban/Confiscation In U.S. Senate

Sen. Bob Menendez last week announced his plan to introduce what he terms the Help Empower Americans to Respond (HEAR) Act when Congress goes back to work on Monday. His bill would reportedly provide some narrow exceptions for “certain current and former law enforcement personnel†and others while outlawing the more than 1 million currently legal suppressors in the country.
Constitutional Carry Bill In Ohio

The measure, HB 178, eliminates the state’s concealed weapons license requirement and codifies the right of a person who is 21 or older and not otherwise prohibited from possessing a firearm to carry a handgun without first getting a CWL. The bill won the 7-4 approval of the House Federalism Committee this week.
