Judge Abridges First Amendment
From Washington Free Beacon:
“Judge Lasnik’s ruling involves some of the most amazing legal acrobatics I’ve ever seen,” Alan Gottlieb, founder of the group, told the Free Beacon. “He has accepted the plaintiffs’ claim that the CAD files are only available on the so-called ‘Dark Web,’ but that’s not at all accurate. The files are available on the normal Internet, and now, thanks to the court, they are available by links in the court record. It is particularly disturbing that Judge Lasnik admitted that the court has decided to not fully explore all the issues because of its limited record, while presuming that we have a First Amendment right to disseminate the CAD files. Then he caps it off by saying that our First Amendment right is only abridged, but not abrogated. That’s like saying the government is only stepping on your neck, they haven’t completely crushed your windpipe.”
“If this case had to do with anything besides guns, we all know that the court would stop this nonsense in a heartbeat and we wouldn’t even be talking about it,” he told the Free Beacon. But because this involves publishing information about guns, suddenly the First Amendment is being treated differently, because the Second Amendment is somehow involved.”
Washington Gun Control Measure Allowed Despite Problems
From MyNorthwest.com:
The billionaires behind I-1639 — at least two of whom apparently enjoy armed guards for themselves — didn’t bother to put the full text of the measure on the initiatives people signed: it-is-not-there. That is not even questionable. There is the proposed law and there is what people signed: the two documents are-not-the-same. Here, used with the permission of WeTheGoverned.com, is the initiative people signed. The red ink indicates where the language has been altered, ignored or changed. This is-not-the-full-text of the measure.
ACLU Defends NRA In New York Case
From ACLU:
In the ACLU’s view, targeting a nonprofit advocacy group and seeking to deny it financial services because it promotes a lawful activity (the use of guns) violates the First Amendment. Because we believe the governor’s actions, as alleged, threaten the First Amendment rights of all advocacy organizations, the ACLU on Friday filed a friend-of-the-court brief supporting the NRA’s right to have its day in court.
1.5 Million Gun Plans Downloaded
From Guns.com:
As a federal court considers an order to continue blocking files for 3D printed guns by a political activist, those same files have been downloaded more than 1.5 million times from another website backed by pro-gun groups.
The website, CodeIsFreeSpeech.com, has generated 1.491 million hits and 4.51 TB of data since launching July 31, said Craig DeLuz, of the Firearms Policy Coalition. He added the site averages more than 10,000 new visitors per week.
Is Gun Control Dead?
From Mises.org:
In present times, gun rights have been under assault at the state and federal level. With blatant calls for the repeal of the Second Amendment and a bipartisan consensus rallying around the need for sweeping gun control legislation, gun rights appeared to be on the chopping block.
Despite the roadbloacks ahead, Defense Distributed has given concerned owners a bit of breathing room and is opening up new avenues for human freedom.
Walmart Illegally Denied 18yr Old A Gun
From Guns.com:
The Oregon Bureau of Labor and Industries this week found that the teen, Hannah Brumbles, was the victim of age discrimination in violation of state accommodations lawafter Walmart refused to sell her a gun over an internal policy. In late February, Walmart said it won’t sell firearms and ammunition to anyone under age 21, citing the Parkland shooting for its nationwide policy reversal.
Gun Companies To Leave CT
Posted by Brian in Law, News, Threat Watch on 25/Aug/2018 07:00
From Guns.com:
High taxes and strict laws encourage gun manufacturers to abandon Connecticut, according to a new report published last month.
“It’s directly related to regulations,â€said Mark Rydzy, owner of the Pauway Company, during an interview with the Connecticut Post in July. “Every time a new series of gun laws goes into effect, it ends up changing everything.â€
NY Gun License Corruption
From Guns.com:
Paul Dean faces up to five years in prison for orchestrating a bribery scheme between at least three dealers and law enforcement officials in the city’s licensing department to fast-track applications for gun permits and overlook certain clients’ violent criminal histories.
Islamists Release On Bail Because Of Their Religion
From The National Sentinel:
Two Muslim men and three women are charged with 11 counts of child abuse each after police raided their compound in New Mexico and discovered 11 malnourished children living in squalor.
Their lawyer argued that there was a double standard in the case because his clients were Muslims. He argued that if they had been Christian and white, “we might not be here today.â€
Judge Blocks Washington Ballot Initiative
From Guns.com:
Thurston County Superior Court Judge James Dixon ruled that the petitions circulated by paid canvassing groups working for the Alliance for Gun Responsibility failed to meet state requirements for readability and did not contain a full and correct copy of the printed measure — which Second Amendment advocates characterized as using “microscopic†text. Dixon said his decision was an easy one.
Texas Blocks Profs’ Lawsuit
From Guns.com:
The panel for the 5th U.S. Circuit on Thursday upheld Texas’ campus carry law, affirming a lower court ruling from last July. The judges found the professors could not prove their case, which largely centered on First Amendment grounds. The faculty members, three female liberal arts professors whose classwork sometimes touches on controversial subjects such as abortion and unwanted pregnancies, argued the carry of guns in their classes would chill open and frank discussion, thus hindering their right to free speech.
California Continues Assault On Guns
Posted by Brian in Law, News, Threat Watch on 20/Aug/2018 16:00
From Guns.com:
In all, eight bills were advanced by the respective Senate and Assembly appropriations committees that would add new requirements to concealed carry licenses, expand the use of lifetime gun bans, make it easier to file so-called “red flag†firearm seizure orders, ration gun sales and strip gun rights from those under age 21. Making it past the fiscal deadline for proposed legislation, each now moves to the chamber floor.
SAF Sues California Over Registration
From The Truth About Guns:
Attorneys for the Second Amendment Foundation and three other advocacy groups have filed an amended complaint against California Attorney General Xavier Becerra, seeking a preliminary injunction to prevent enforcement of a new law restricting possession of so-called “bullet button assault weapons†because of a problem with the registration system during the week prior to the deadline.
Cody Wilson To Sue Shopify
Posted by Brian in Law, News, Threat Watch on 17/Aug/2018 17:00
From Guns.com:
Cody Wilson is no stranger to litigation. Having spent the better part of five years locked in a battle against the State Department over the legality of 3D printed files, Wilson finally won his case and earned the right to publish his digital blueprints. Now, just a month after his victory, Wilson is looking to, again, step into the courtroom but this time against e-commerce platform Shopify.
Second Amendment History
From National Review Online:
Stop me if you’ve heard this one before. In 1791, the Founding Fathers placed into the U.S. Constitution a set of ten amendments that we refer to collectively as the “Bill of Rights.†Among them was an innocuous measure designed to protect state militias against federal overreach. Until the 1970s, nobody believed that this meant anything important, or that it was relevant to modern American society. But then, inspired by profit and perfidy, the dastardly National Rifle Association recast the provision’s words and, sua sponte, brainwashed the American public into believing that they possessed an individual right to own firearms.
