Court: Bump Stock Ban Unconstitutional

A divided federal appeals court in Ohio ruled that former President Donald Trump’s ban on bump stocks is unconstitutional and should no longer be enforced by the Bureau of Alcohol, Tobacco, Firearms, and Explosives.

Then, as we neared the election, the ATF dropped an October surprise, declaring some braced pistols were actually SBRs — NFA-regulated short barreled rifles — only to later back off that determination under pressure. That declaration was in direct disobedience to the Department of Justice’s edict (which happened, in a big part, thanks to Rep. Gaetz with help from brace manufacturer SB Tactical) that ATF could not pursue any new rulings or regulations on pistol braces without first setting clear standards for the accessories in cooperation with the firearm industry.

Gorsuch just got some company. This week, Judge Brantley Starr, a Trump appointee who sits on the U.S. District Court for the Northern District of Texas, issued an opinion in Lane v. United States that basically accused the Justice Department of ignoring basic principles of constitutional governance in its defense of the Trump administration’s bump stock ban.
Project Guardian Encourages More Vigilance With Current Gun Laws

Project Guardian, introduced by Attorney General William Barr last month, is a multifaceted plan that will rely on improved information sharing to more effectively enforce current firearms laws and better prosecute the criminals who violate them. Primarily, Project Guardian places increased reporting standards on federal law enforcement to regularly share with state law enforcement the lists of persons rejected from buying a firearm under the National Instant Criminal Background Check System (NICS). More specifically, this memo directs the offices of all U.S Attorneys to more promptly submit to NICS case records of individuals who become legally ineligible to own firearms. This will greatly reduce the lag time between a court’s decision to determine an individual is disqualified from buying or possessing a firearm and the NICS database having knowledge of that determination.
ATF’s Continued Bad Rulings

As Davis noted, in 2010 the agency said bump stocks weren’t “machineguns,†that a bump stock “performs no automatic function when installed. In order to use the installed device [the bump stock], the shooter must apply constant forward pressure with the non-shooting hand and constant rearward pressure with the shooting hand.â€
Rejecting its 2010 determination, the BATFE now says that a bump stock causes a semi-automatic firearm to fire “in a manner that allows the trigger to reset and continue firing without additional physical manipulation of the trigger by the shooter.â€
Gun Group Files Massive Comment In Support Of Bump Stocks

The more than 900-pages of documentation was compiled with the assistance of attorneys Joshua Prince and Adam Kraut of the Pennsylvania-based Firearms Industry Consulting Group, argue that the prohibition could affect as many as 500,000 bump stock owners unconstitutionally, making those who don’t comply subject to criminal action and those who do left without compensation for their legally-purchased property.

Operation Choke Point Under Scrutiny

EFF recently received dozens of pages of documents in response to a FOIA request we submitted about Operation Choke Point, a Department of Justice project to pressure banks and financial institutions into cutting off service to certain businesses. Unfortunately, the response from the Department of Justice leaves many questions unanswered.
EFF has been tracking instances of financial censorship for years to identify how online speech is indirectly silenced or intimidated by shuttering bank accounts, donation platforms, and other financial institutions. The Wall Street Journal wrote about the Justice Department’s controversial and secretive campaign against financial institutions in 2013, and one Justice Department official quoted in the article stated:
ATF White Paper Leaked, Suggests Sweeping Changes

The “white paper†by Ronald B. Turk, associate deputy director and chief operating officer of the ATF, calls for removing restrictions on the sale of gun silencers; allowing gun dealers to have more guns used in crimes traced to their stores before the federal government requires additional information from the dealer; and initiating a study on lifting the ban on imported assault weapons.

Defense Distributed Part of New Documentary

In the film, Wilson is openly positive about the election of Donald Trump, which may help explain the film’s chilly reception among the liberal-leaning Sundance audience. Then again, there are plenty of reasons for people on the left — Lough included — to find Wilson unsettling. Lough interviews him at length in The New Radical, about other pioneers of the crypto movement, other libertarian radical activists, and how printable weapons level the playing field for anyone who wants a potentially undetectable plastic gun without any government oversight.
