Slate Concerned About Right Wing Violence, Silent On Left Wing Violence

Though they vary across the states, the anti–private army laws target the same basic phenomenon: forming armed groups not answerable to civil authorities, providing paramilitary training for use in civil disorders, and falsely assuming police or military roles. The constitutional provisions and statutes can form the basis for injunctions prohibiting members associating together while armed or setting up training camps, restrictions on public events like rallies, and even criminal prosecutions.

Evidence New York Violated NRA’s Free Speech

In June of 2019, the NRA achieved a breakthrough: in an attempt to negotiate resolution of the NRA’s pending subpoena, Lloyd’s America, Inc. (“LAI”) provided a small number of documents voluntarily to the NRA, subject to a strict confidentiality order. Those documents, and additional details which have come to light since that time, paint a stark and troubling picture of Defendants’ conduct. As described in the NRA’s proposed amended pleading, former DFS Superintendent Vullo was fully aware of identical market conduct by non-NRA entities, yet leveraged DFS’s considerable power over Lloyd’s to inflict harm on “gun programs”—irrespective of whether those programs violated the law. These threats were delivered in off-the-record conversations and surreptitious backroom meetings. Taken aback by such conduct, insurance- industry insiders, including Lloyd’s, privately predicted that the NRA would sue DFS. They were right.

Judge Says There Should Be A License For 3D Printing Software

This week, Judge Robert A. Lasnik of U.S. District Court for the Western District of Washington, in deciding on motions for summary judgment in that suit, State of Washington et al. v. U.S. Department of State et al., agreed that removing those files from the USML was unlawful based on the APA arguments (though not the 10th Amendment ones), and reversed the federal government’s choice to allow free distribution of the files.
As discussed in Lasnik’s decision, the federal government’s initial reaction to the states’ suit “justified the deregulation of the CAD files [that could help make weapons]…by pointing to a Department of Defense determination that the items ‘do not provide the United States with a critical military or intelligence advantage’ and ‘are already commonly available and not inherently for military end-use.'”

School Suspends Girl For Gun Photo

On Oct. 11, Endeavor Academy, a public school in Centennial, Colo., suspended 17-year-old senior Alexandria Keyes for five days after she posted a picture of herself and her older brother on the social media app Snapchat. The two are shown holding guns and the photo is captioned, “Me and my legal guardian are going to the gun range to practice gun safety and responsible gun ownership while getting better so we can protect ourselves while also using the First Amendment to practice our Second Amendment.”

NJ Now Going After Banks That Do Business With Gun Industry

New Jersey intends to stop doing business with gun manufacturers and retailers that fail to adopt policies, like conducting background checks, to stop guns from falling into the wrong hands, becoming the first state to take such stringent action against the firearms industry.
The state will also apply pressure on major financial institutions, seeking information from banks that do business with New Jersey about their relationships and policies involving gun makers and sellers.

NY’s Due Process Problem With Red Flags

The new law allows a long list of people to seek an “extreme risk protection order” that bars the respondent from possessing firearms. Potential petitioners include police officers, prosecutors, blood relatives, in-laws, current and former spouses, current and former housemates, current and former girlfriends or boyfriends, people who have produced a child with the respondent, and school administrators or their designees, such as teachers, coaches, and guidance counselors. The “school personnel” covered by the law can even report a former student if he graduated within the previous six months.

Harris Says Confiscate Guns Of Bigots

Sen. Kamala Harris (D–Calif.), who is seeking the 2020 Democratic presidential nomination, says that if elected she will push legislation that would authorize federal courts to issue gun confiscation orders against people who express opinions that may indicate an intent to commit a hate crime. These “domestic terrorism prevention orders” would “temporarily restrict a person’s access to guns if they exhibit clear evidence of dangerousness,” including “violent racist threats or anti-immigrant manifestos.”

Florida College Suspends Student For Range Picture

From Bearing Arms:

The picture wasn’t actually threatening. It wasn’t the kind of pic I personally approve of, really. Muzzle discipline is a thing, after all, but she at least kept the booger-hook off the trigger, which puts her leaps and bounds over some. There was no menace to the picture unless you were actively trying to find it.
So, they suspended her.
