ATF/FBI Still Have Questions To Answer About Waco

Twenty-five years ago today, FBI tanks smashed into the ramshackle home of the Branch Davidians outside Waco, Texas. After the FBI collapsed much of the building atop the residents, a fire erupted and 76 corpses were dug out of the rubble. Unfortunately, the American political system and media have never faced the lessons from that tragic 1993 day.

Ares Armor vs ATF

The United States District Court for the Southern District of California ruled against Ares Armor in its lawsuit against the Bureau of Alcohol, Tobacco, Firearms and Explosives in a decision filed Thursday. United States District Judge Janis L. Sammartino, a George W. Bush appointee, ordered dismissal of plaintiff claims.

Ares claimed First, Second and Fifth Amendment violations by ATF, as well as a violation of the Firearm Owners Protection Act.  ATF argued for dismissal, citing “lack of subject matter jurisdiction …  [and] failure to state a claim,” as well as for summary judgment on the claim by Ares that classifying the part as a firearm was “arbitrary.”

New ATF Ruling Makes It A Crime To Use A Business’s Machinery To Make Your Own Gun

From The Examiner:

The ruling, signed by ATF Director B. Todd Jones on Friday, also holds that the businesses must “identify (mark) any such firearm and maintain manufacturing records,” and that Gun Control Act requirements may not be avoided by allowing persons to perform processes on machinery, tools and equipment a business controls access to. Excluded from the ruling are weapons and devices regulated by the National Firearms Act.

Justice Department Using FDIC To Hurt Gun Retailers

Since 2011, regulators have increased scrutiny on banks’ customers. The Federal Deposit Insurance Corp. in 2011 urged banks to better manage the risks of their merchant customers who employ payment processors, such as PayPal, for credit card transactions. The FDIC listed gun retailers as “high risk” along with porn stores and drug paraphernalia shops.

Lost ATF Gun Kills Police Chief

A high-powered rifle lost in the ATF’s Fast and Furious controversy was used to kill a Mexican police chief in the state of Jalisco earlier this year, according to internal Department of Justice records, suggesting that weapons from the failed gun-tracking operation have now made it into the hands of violent drug cartels deep inside Mexico.

Standard Chartered Bank Agrees to Forfeit $227 Million for Illegal Transactions with Iran, Sudan, Libya, and Burma

From FBI:

Standard Chartered Bank, a financial institution headquartered in London, has agreed to forfeit $227 million to the Justice Department for conspiring to violate the International Emergency Economic Powers Act (IEEPA). The bank has agreed to the forfeiture as part of a deferred prosecution agreement with the Justice Department and a deferred prosecution agreement with the New York County District Attorney’s Office for violating New York state laws by illegally moving millions of dollars through the U.S. financial system on behalf of sanctioned Iranian, Sudanese, Libyan, and Burmese entities. The bank has also entered into settlement agreements with the Treasury Department’s Office of Foreign Assets Control (OFAC) and the Board of Governors of the Federal Reserve System.
