Case Could Reign In Federal Bureaucracies

Recently, there has been a push from some quarters to reconsider Auer deference, Chevron deference, and other aspects of the modern administrative law state, and overturn them as being inherently unconstitutional; specifically, that such deference to bureaucratic decisions violates the required Separation of Powers.Â
Were that to happen, the current administrative state would be rocked to its core. While there have been some rumblings from Justice Thomas and others in this regard, there did not appear to be a majority on the Supreme Court interested in potentially unleashing this kind of political earthquake. (Scalia and Kennedy were, at best, squishy on the issue.)
ATF Changes Accessory Review

“Effective immediately, any requests for a determination on how an accessory affects the classification of a firearm under the GCA or NFA must include a firearm with the accessory already installed,†noted ATF. “Except in cases of conditional import determinations, FTISB will not issue a determination on an accessory unless it is attached to the submitted firearm.â€

M4 Stolen From ATF. Who Will Be Held Responsible?

Equipment to include a select-fire Colt M-4 rifle was snatched in a burglary of an agent’s vehicle parked near a Bay Area federal building. Stolen in the smash-and-grab Tuesday evening from a Bureau of Alcohol, Tobacco, Firearms, and Explosives vehicle besides the M4 were a 9mm Glock, handcuffs, an ATF radio, and a Taser, reports the East Bay Express.
Bump Stock Ban Coming?

CNN was the first to report the news yesterday evening, citing “officials familiar with the matter.” An administration official confirmed to The New York Times that the rule would be unveiled “in the coming days to weeks.” Under Trump’s new regulation, a source tells CNN, bump stock owners would have 90 days to get rid of the devices on their own or turn them over to authorities.

Republican Wants Weed Question Removed From Gun Form

Although marijuana is legal for adults in nines states, and as medical cannabis in 30, it remains listed as a highly-addictive and dangerous Schedule I drug with the federal government. It also shares the same designation as ecstasy, heroin, and LSD. This has resulted in the Bureau of Alcohol, Tobacco, Firearms and Explosives maintaining a status quo that any sale or possession of firearms by those who use marijuana, even if allowed by state law, remains criminal.

Judicial Watch announced today that it filed a brief in the United States District Court for the District of Columbia asking the court to order the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to produce more than 1,900 pages of records relating to the ATF’s proposed reclassification that would effectively ban certain types of AR-15 ammunition as armor-piercing.
Gun Group Files Massive Comment In Support Of Bump Stocks

The more than 900-pages of documentation was compiled with the assistance of attorneys Joshua Prince and Adam Kraut of the Pennsylvania-based Firearms Industry Consulting Group, argue that the prohibition could affect as many as 500,000 bump stock owners unconstitutionally, making those who don’t comply subject to criminal action and those who do left without compensation for their legally-purchased property.

Bill To Strip ATF of Some Powers

In its present form, the measure it would protect large caliber rifles and shotguns from being reclassified as “destructive devices†under the National Firearms Act. In several states, rifles chambered in .50 caliber BMG have been banned and Bishop’s legislation would prevent such a curtailment on the federal level.
Next, the bill would remove ATF’s ability to reclassify ammunition as being armor piercing. This could derail past rule changes such as seen with the 5.45mm 7N6 loading as well as the attempted reclassification of “green tip†ammunition.
ATF White Paper Leaked, Suggests Sweeping Changes

The “white paper†by Ronald B. Turk, associate deputy director and chief operating officer of the ATF, calls for removing restrictions on the sale of gun silencers; allowing gun dealers to have more guns used in crimes traced to their stores before the federal government requires additional information from the dealer; and initiating a study on lifting the ban on imported assault weapons.

The Trace: 85% Of Bump Stock Comments Against Regulation

The Trace discovered that of all the comments to the ATF on bump stocks 85% were against regulation with a good majority of those comments being unique as opposed to a form letter.
