FPC Attacks ATF Rule As Unlawful

Today, the Department of Justice officially released a notice of proposed rulemaking announcing a new ATF rule which would, among other attacks on firearm owners, builders, and dealers, redefine the terms “receiver†and “frame.†FPC previously issued a statement regarding a leaked, draft version of the new rule in mid-April. How The ATF Arbitrarily Creates Criminals
What if government agents could, by declaration, make you into a criminal? What if, without legislative change, bureaucrats could decide that what was legal yesterday is a felony today? What if we were governed not by law, but by arbitrary statements telling us what we may or may not do?
Unfortunately, those questions are not merely hypothetical—thanks to recent abuses of power by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), millions of American gun owners are facing them head-on. Even if you hate guns, you should be deeply concerned by the arbitrary power wielded by the ATF against your fellow Americans. If an unchecked executive agency can run roughshod over any of our rights with impunity, all of our rights are in danger.
Trump Appointed Judges Slam Bump Stock Rule

Gorsuch just got some company. This week, Judge Brantley Starr, a Trump appointee who sits on the U.S. District Court for the Northern District of Texas, issued an opinion in Lane v. United States that basically accused the Justice Department of ignoring basic principles of constitutional governance in its defense of the Trump administration’s bump stock ban.
ATF Stalling On Ammo Docs

We sued after the agency failed to respond to our May 14, 2018, FOIA request for the 1,900 documents about the Obama administration’s AR-15 ammo ban efforts. The documents include ATF talking points about the “Armor Piercing Ammunition Notice of Proposed Rulemaking†and other records discussing ammunition classification.
New ATF Ruling Makes It A Crime To Use A Business’s Machinery To Make Your Own Gun

The ruling, signed by ATF Director B. Todd Jones on Friday, also holds that the businesses must “identify (mark) any such firearm and maintain manufacturing records,†and that Gun Control Act requirements may not be avoided by allowing persons to perform processes on machinery, tools and equipment a business controls access to. Excluded from the ruling are weapons and devices regulated by the National Firearms Act.
The “80% Lower” Situation

Here’s a not so well kept secret, there’s no such thing as an 80% lower in the eyes of the BATF — it’s either a gun or it isn’t. The phrase “80% lower†was coined by a cleaver marketer of incomplete AR lowers years ago and it stuck.
The actual regulation in the Gun Control Act that all this hubbub is based on states, “(A) any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive; (B) the frame or receiver of any such weapon.â€
ATF Used Mentally Disabled Teens to Run Sting Then Arrested Them

If you thought the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) couldn’t stoop any lower, you’d be wrong. The Milwaukee Journal Sentinel reports that the agency responsible for setting off the events that led to Waco and were at the center of the Fast and Furious gun-walking scandal are using mentally disabled teenagers to advertise businessess that are actually fronts for ATF sting operations.
ATF Raids FPSRussia With No Probable Cause

When Guns.com talked to the ATF about this incident the ATF spokesman Richard Coes said he didn’t know why ATF agents suspected Myers of wrongdoing. However, he told local media that “the claim is that he was using explosives and getting paid for it via YouTube.â€
Tannerite is used in many of his videos, which is legal to own. Expect the ATF to “make a ruling” that tannerite is now illegal.
