The 2nd and 14th Amendment Working Together

Every now and then a case, a law comes into focus to remind us just how far we remain from the dream of equal protection under the law. Such a case appears this week in the State of California where the betters have moved Senate Bill 707 to Governor Jerry Brown’s desk for consideration.
SB 707 is a gun control bill. It is part of a larger strategy of zero tolerance gun control measures with the real aim to trip people up in ways that even the smallest mistake causes them to lose their gun rights. SB 707 adds a new tripwire to the Gun Free Zone laws that surround 1,000 feet around every school in California threatening everyone, even those with a dire need or legal permit, from being within these zones with a gun. Everyone that is, except for the one lobby Sacramento needed to support this law, retired police officers. Even though they are no longer law enforcement officers and do not have any police powers, they will be granted a privilege no other citizen will have in the State of California. Indeed, there are lobbyists that seem to believe that retired police officers are not subject to living among their lowly fellow citizens as equals under the 14th Amendment; that they are better, exempt; that they are not “little people”.
Senator Kaine’s Gun Control Bill

Kaine’s proposed law, entitled the “Responsible Transfer of Firearms Act,†places a criminal federal liability on anyone who transfers a firearm to an individual prohibited from possessing one by federal law, according to a fact sheet provided by Kaine’s office. Under current law, only federal firearms licensees (FFLs) are criminally liable if they sell a gun to a prohibited individual. Kaine’s law would extend that criminal liability to private individuals as well.
Best Summer For Guns

This August saw 1.7 million background checks performed by the Bureau of Alcohol, Tobacco, Firearms, and Explosives on new gun sales, the most checks ever performed in any August since the creation of the National Instant Background Check System. The agency performed 1.6 million checks in July, the high for that month. They did a further 1.5 million in June, another all-time high.
Young Adults Flocking To Firearms

Angela Aliff, 33, has been shooting since she was 10 years old. When the Tampa health care professional moved out on her own, her father bought her a handgun.
Collazo estimates about 35 percent of shooter range in age from 21 to 35. They’re young professionals like 25-year-old Kierron Conner who’s trying out his Glock G23 for the first time after purchasing the weapon at a gun show. He recently completed a concealed weapons course and the training has been an inspiration for his older brother, Danny, 28, to get back into practice after a six- year hiatus.
What Would Repealing The Second Amendment Look Like?

We should be absolutely clear about what Delaney is arguing here: He is a) agreeing with Jefferson that “laws and institutions must go hand in hand with the progress of the human mind,†b) contending that “progress†suggests that the individual right to keep and bear arms is now counterproductive, and c) concluding that it is time therefore to make a “change in law and constitution†— in other words, to repeal the Second Amendment. This, it is true, is not a mainstream position on the American Left — at least, it is not one that is argued openly. But it is a reasonably popular one on social media, it has strong support within the more leftward-leaning parts of the political commentariat, it is often implied by the casual manner in which progressives such as President Obama refer to “Australia†and other heavily regulated nations, and it enjoys indirect approval from around one quarter of the American public. When the likes of Rob Delaney and Bill Maher and Keith Ellison say that we need to get rid of the Second Amendment, they are not speaking in a vacuum but reflecting the views of a small but vocal portion of the American population. And they mean it. That being so, here’s the million-dollar question: What the hell are they waiting for? Go on, chaps. Bloody well do it.

As we reported in June, the Obama Administration’s State Department (DOS) proposed a revision of the International Traffic in Arms Regulations (ITAR) on June 3 that would require anyone seeking to make certain types of information about firearms publicly available to first obtain government approval. Prior restraints of the sort contemplated by the proposal are among the most disfavored regulations of speech under First Amendment case law. Our original alert encouraged gunsmiths, manufacturers, reloaders, serious hobbyists, and others who rely on design, development, production or manufacturing information about firearms to file comments with the State Department opposing the rule and explaining its problems.
NRA, SAF and NSSF Sue Seattle Over Gun Tax

The National Rifle Association, along with the National Shooting Sports Foundation and the Second Amendment Foundation, has filed a lawsuit against the city of Seattle for violating a Washington state law that prevents local municipalities from creating their own firearm regulations. The suit was filed in King County Superior Court this morning.
On August 10, the Seattle City Council approved measures that tax the sales of all firearms and ammunition and require gun owners to report any lost or stolen firearms. The tax is scheduled to take effect in January 2016.
Idaho Residents Face Down Feds Over Second Amendment

On August 6, residents and Bonner County Sheriff Daryl Wheeler lined up outside the Priest River, Idaho, home of veteran John Arnold to prevent the Veterans Administration (VA) from taking away his guns…
Roughly “100 people†showed up, including Sheriff Wheeler. Those assembled waved an American flag, a Gadsen flag, and sang patriotic songs. Wheeler said: “I took an oath to uphold the U.S. Constitution and uphold the laws of Idaho. This seemed appropriate to show my support. I was going to make sure Mr. Arnold’s rights weren’t going to be breached.â€
I wonder why I haven’t seen this on the national news? Maybe because the media doesn’t want The People to get the idea that they can effectively nullify federal overreach just by saying “no”.
Defense Distributed Injunction Against State Department Denied

This week U.S. District Judge Robert Pitman denied a motion for a preliminary injunction against the State Department in the case of Defense Distributed v. U.S. Dep’t of State.
Quotes and comment from Judge Pitman’s decision.
He starts with explaining that it takes a lot to get a preliminary injunction to stop someone from an action you assert violates your rights, and he believes the very fact it took DD so long after the injury to file suit proves that they do not face any urgent necessity to stop the State Department from violating their rights.
Judge Pitman does then grant that, well, precedent states that First and Second Amendment violations do rise to the level of “irreparable”  that might demand an injunction.
Seattle To Tax Ammo And Guns

If approved, a $25 tax would be added to all gun sales, along with a 5-cent tax on every cartridge sold. In addition, gun owners would be required to report the loss or theft of firearms within 24 hours.
Critics of the plan, such as Trevor Santos, manager of government relations for the National Shooting Sports Foundation, say it will cause residents to “travel to retailers outside Seattle,†and that it’s just another example of penalizing law-abiding citizens, because criminals don’t acquire their firearms legally.
Protest In Idaho Over Possible Gun Confiscation

Idaho Republican state Rep. Heather Scott of Blanchard said the Veteran Affairs office has sent a letter to John Arnold of Priest River warning him that he cannot possess or purchase firearms.

Study Says More Armed Civilians Equals Less Crime

Overall, the study notes, between 2007 and 2014, as permit numbers have increased, “murder rates have fallen from 5.6 to 4.2 (preliminary estimates) per 100,000. This represents a 25% drop in the murder rate at the same time that the percentage of the adult population with permits soared by 156%. Overall violent crime also fell by 25 percent over that period of time.â€
