Missouri’s Gun Sanctuary Law Struck By Federal Court
From The Federalist:
Both the District Court and the Eighth Circuit saw things differently, and by enjoining Missouri’s law, have forced the state to use resources and its employees to enforce federal gun laws. That could include materially supporting the compilation of gun owner records for the ATF’s gun registry, the enforcement of President Joe Biden’s “zero tolerance” policy against Missouri gun dealers, or helping a hypothetical Kamala Harris administration in confiscating AR-15s under a future “assault weapons” ban.
The precedent is clear, the federal government has no authority whatsoever to compel a state to enforce a federal law. So, what’s the difference here? Sadly, all too many federal judges stubbornly believe the Second Amendment is a second-class right. In the case of the recent ruling against SAPA, the Eighth Circuit simply invoked the Constitution’s supremacy clause, and gave the back of its judicial hand to Missouri and every other state that might question the constitutionality of a federal law — at least a federal gun law.
Gun Sanctuaries Take Hold In Pacific Northwest
From Bearing Arms:
In recent months the Pacific Northwest has been ground zero for the movement, and Second Amendment activists in Oregon were able to put Second Amendment Sanctuary ordinances on the ballot in four Oregon counties. The ordinances won the approval of voters this week in Columbia and Umatilla counties, while the ballot measure was rejected in Clatsop and Coos counties (where local officials had campaigned against the proposal).
How Will Virginia Enforce New Gun Laws?
From Open Source Defense:
A sheriff in a rural county couldn’t enforce this law even if they wanted to. 140,000 armed citizens in noncompliance would account for 1.6% of the entire Virginia population. Best estimates of the Syrian civil war show that even at it’s peak, only 1% to 2% of the nation were active combatants, counting all sides. And the noncompliant gun owners have home turf, and are probably better equipped and better marksmen than many of the folks in Syria. The barrier to enforcement isn’t just ideological, it’s functional.
Attacking Gun Sanctuaries With Comparisons To Slavery
From The Washington Examiner:
In linking it to slavery, he wrote, “A sad irony is that the ‘sanctuary’ movement conjures the disturbing nullification movements of the past three centuries in Virginia. Thomas Jefferson and James Madison argued that the states have the right to ignore federal laws they consider unconstitutional. That thinking was applied to proslavery movements, leading to the Civil War and the fight over integration in the 1950s and 1960s.â€
Virginia County Goes A Step Further Than Sanctuary
From Bearing Arms:
That answer is “On Dec. 3rd, 2019, our Board of Supervisors chose to exercise some of its rights under the Virginia Constitution to order or regulate militia. By insuring that our residents have the opportunity (1) to possess certain types of firearms, (2) to educate themselves on their use, (3) to learn common military practices, and (4) to learn basic survival skills, we hope to preserve a group of residents who could form a militia, were such a body needed. Without these most basic elements our County would not have a group of persons from whom a militia could be drawn. At the moment, however, the Board has not called any such militia to arms and prays that such moment never occurs.â€
Join NRA At Virginia State Capitol On Jan. 13
From NRA-ILA:
This fight begins on January 13th during the first hearing of the Senate Courts of Justice Committee, and we must hold tyranny in check.  While it is important for Virginia gun owners to make their voices heard at all times, it is critical on this first day. Â
Americans Continue History Of Disobedience
From The Truth About Guns:
Alongside the swirl of headlines about the Second Amendment sanctuary movement in Virginia, there are the echoes of other courageous American patriots who have battled lawless tyrants in their time.
The wailing, gun-confiscating leftists of 2019 need to know this: declarations of “We will not comply!†in America are as old as the fruited plain.
Liberals Angered By Conservative Non-compliance
From The Washington Times:
Some on the left are angry, if not apoplectic, that conservatives are turning the tables on them and co-opting one of their own tactics against liberal policies. But turnabout, as they say, is fair play: Self-styled “progressives,†it seems, aren’t the only ones who can unilaterally decide which laws they will or will not enforce and/or comply with.
Virginia Gun Owners Prepare To Disobey
From MSN:
In the past two weeks, county governments from the central Piedmont to the Appalachian Southwest — Charlotte, Campbell, Carroll, Appomattox, Patrick, Dinwiddie, Pittsylvania, Lee and Giles — have approved resolutions that defy Richmond to come take their guns.
2nd Amendment Sanctuary Movement
From Reason:
The phrase “Second Amendment sanctuary” is an umbrella term used to describe a jurisdiction that passes a resolution declaring that restrictive gun control laws another legislative body passes are unconstitutional and will not be enforced there. The concept is an adaptation of the immigration “sanctuary city” movement, in which some cities and counties (and now whole states) generally decline to ask residents about their immigration status or assist the federal government in enforcing immigration laws. The resolutions can vary, but generally, Second Amendment sanctuaries refuse to dedicate resources to enforcing things like “red flag” laws and bans on certain weapons.
Sanctuary Idea Is A “Stunt” When Used To Defend Gun Rights
From The Star-Telegram:
The first local outbreak of hysteria was in Hood County. This week, it spread to Parker County, where commissioners approved a resolution declaring the county a “sanctuary†for Second Amendment rights.
Towns Becoming Gun Sanctuaries
From Bearing Arms:
Foster is the fourth Rhode Island town, including Burrillville, Hopkinton and West Greenwich, to became Second Amendment sanctuary towns in response to Gov. Gina Raimondo’s proposal for stricter state gun laws. Raimondo bills propose a ban on assault-style weapons, a limit on the number of bullets allowed in a clip, and prohibiting guns from school ground unless carried by a police officer.
Texas Senator Introduces Gun Sanctuary Bill
From The National Sentinel:
Sen. Bob Hall (R-Edgewood) filed Senate Bill 378 (SB378) on January 17. The bill would prohibit any state government agency, personnel or public funds from enforcing any federal gun control regulation or law “if the federal statute, order, rule, or regulation or international law imposes a prohibition, restriction, or other regulation, such as a capacity, size, or configuration limitation, that does not exist under the laws of this state.â€
8 Oregon Counties Pass Sanctuary Gun Laws
The Oregonian/OregonLive reported Wednesday that the ordinances say that residents of those counties now have the right to own semi-automatic weapons and high-capacity magazines, regardless of state or federal law.
