Tuesday’s legal effort underscores a decades-long tension between western states and the federal government, as they wrestle over control of vast land areas. For years, locals have sought permission to utilize the land for harvesting timber, oil, and gas, grazing animals, and pursuing other opportunities, but Washington bureaucrats have blocked their efforts. The lawsuit filed by Utah raises issue with “unappropriated” land held by the Bureau of Land Management, noting that 34 percent of “total state territory” is unappropriated land under federal control.

The black Isuzu with California plates headed west on Interstate 80 into the Sierra Nevada, eventually crossing the Nevada state line. That’s when the California Highway Patrol pulled Vincent Huey over. Inside the vehicle, state Justice Department agents found 18 high-capacity magazines, some capable of holding 30 rounds, according to court records.

Third Amendment Argument Rejected in Nevada Case

In the present case, various officers of the HPD and NLVPD entered into and occupied Linda’s and Michael’s home for an unspecified amount of time (seemingly nine hours), but certainly for less than twenty-four hours. The relevant questions are thus whether municipal police should be considered soldiers, and whether the time they spent in the house could be considered quartering. To both questions, the answer must be no.

I hold that a municipal police officer is not a soldier for purposes of the Third Amendment. This squares with the purpose of the Third Amendment because this was not a military intrusion into a private home, and thus the intrusion is more effectively protected by the Fourth Amendment. Because I hold that municipal officers are not soldiers for the purposes of this question, I need not reach the question of whether the occupation at issue in this case constitutes quartering, though I suspect it would not.

Showdown In Nevada Between Rancher and the Feds

Armed federal agents from the FBI and Bureau of Land Management have surrounded a ranch in Nevada in order to protect an endangered tortoise.

From The Washington Free Beacon:

His wife, Carol Bundy, said that roughly 200 armed agents from the BLM and FBI are stationed around their land, located about 75 miles outside of Las Vegas. Helicopters circle the premises, and the airspace and nearby roads remain blocked.

As of Monday, officials have seized 234 of Bundy’s 908 cattle. Impounding the cattle alone could cost the government as much as $3 million.

When the priority of the government goes this far astray is when people get hurt. Let’s hope the situation is resolved in a just manner.
