ATF Using Loophole To Create Illegal Gun Registry

AmmoLand News has reported that the ATF has been scanning nearly one billion “Out of Business” records using optical character recognition (OCR) software. If you did not know already, out-of-business FFL’s 4473 documents from gun sales made over the duration of that business have been turned over to the ATF. These “out of business” documents include personal information, including social security numbers, addresses, height, weight, eye color, etc. The ATF claims that this database is not searchable by name. This claim is true on the surface because the ATF has disabled the field within the software, but that field can be easily re-enabled at any time with just a few clicks of a mouse.

Democrats Introduce Bill To License And Register All Handguns

Plainly titled the Handgun Licensing and Registration Act of 2021, the proposal would require that any handgun owner be at least 21 years of age. Before their mandatory license is issued for a pistol or revolver, would-be handgun owners would first complete approved firearms training and clear a background check after submitting fingerprints and photographs. Licenses would have to be renewed every five years.

They’ll Never Stop Going After Guns

A gun control bill that Rep. Sheila Jackson Lee (D–Texas) recently introduced gives you an idea of what Democrats might do if they did not have to worry about the Second Amendment. The Sabika Sheikh Firearm Licensing and Registration Act would establish a national database that is supposed to include every gun in the country, make it a felony to own a firearm or ammunition without a license from the Justice Department, ban magazines that hold more than 10 rounds and “ammunition that is 0.50 caliber or greater,” and criminalize possession of a “military-style weapon” without a special license. Violating the bill’s provisions would be punishable by hefty fines and long minimum prison sentences, which Lee ordinarily claims to oppose.

Washington Post Advocates Disarming Americans

The other day, Karen Attiah, Global Opinions editor at the Washington Post, one of the largest and most prestigious newspapers in the world, reasoned that “if America were another country, we would be talking about how post-Civil War America is still in desperate need of a U.N.-sponsored Disarmament, Demobilization and Reintegration (DDR) program for white supremacists and segregationists.”

Well, perhaps “reasoned” is an overstatement. The idea, of course, is as preposterous as it is juvenile, but more seriously, it betrays a corrosive illiberalism and warped understanding of American life that’s infected so much of the Left these days.

WA Confiscation Law Unconstitutional

Earlier this year, in a ruling of first impression in Washington State, the Kitsap County District Court decided that the state’s compulsory “firearm surrender” laws violated the Fourth and Fifth Amendments and the analogous provisions in the state constitution. “In our constitutional system of government, individuals have rights that the government and its agents (including courts) must respect. Among those rights are the right to be free from compelled self-incrimination under the Fifth Amendment, the right to be free from unreasonable searches and seizures under the Fourth Amendment, and their counterparts under Washington’s constitution.”

California and New Jersey have enacted laws to confiscate firearms magazines holding more than 10 rounds. On Aug. 14, a 2-1 panel of the Ninth Circuit ruled California’s confiscation unconstitutional, in Duncan v. Becerra. The Third Circuit, Sept. 1, upheld by 2-1 confiscation in New Jersey in Association of New Jersey Rifle and Pistol Clubs Inc v. Attorney General New Jersey (NJ Rifle II). In combination, Duncan and NJ Rifle II cases provide a good view of the state of the Second Amendment argument today.

It’s a little game political media like to play — the Associated Press miraculously ran almost an identical piece on the same day — in which reporters take a hyperbolic backbencher’s comments or a misleading social-media post — in this case, a Facebook post that is “gaining traction” — and use it as a strawman to deceive voters about one of the controversial positions of their favored politician.
