California Magazine Ban Blocked

The battle to secure Second Amendment rights is ever-evolving. On Monday, gun owners were dealt a disappointing blow with the Supreme Court’s refusal to review the legal scheme that empowers California counties to effectively ban the bearing of arms (see related article). Yet by Thursday, Second Amendment advocates were cheering a federal court’s opinion blocking enforcement of California’s draconian magazine ban. That opinion, in Duncan v. Becerra, shows what’s possible when a federal judge treats the right to keep and bear arms with the respect deserved by all provisions within the Bill of Rights.

Czech Republic Moves To Expand Gun Rights

Exactly two weeks after the Czech Republic announced that they would challenge restrictive changes to the European Union’s European Firearms Directive in the European Court of Justice, the small nation has once again acted to defend themselves against transnational gun controllers. On June 28, the Czech Chamber of Deputies (the lower house of the Czech Parliament) approved a constitutional amendment to protect Czech citizens’ right to possess firearms and ammunition, with a reported 139 of 200 deputies voting in favor.

Specifically, the proposed constitutional amendment ensures that Czech citizens have a right to keep and bear arms in order to participate in preserving national security.

NRA Is Now Selling Insurance For Self Defense

…last month the NRA announced a new insurance product, Carry Guard, which they marketed to their millions of members online and at their annual meeting in Atlanta. The idea of firearms liability insurance has been previously championed by gun safety advocates on the left, who envisioned insurance as an instrument of public safety that could encourage safer guns and safer behavior. As implemented by the NRA, though, firearms liability insurance has a different function—to insulate gun owners from the expense and other possible consequences of a shooting.

Powell explains that Carry Guard was created to accommodate the needs of a changing culture in the U.S., where more people carry concealed weapons. “There’s just been this incredible carry revolution that’s taken place over the past eight years, and you know, the NRA started it. We started this in Florida 35 or 36 years ago, passing the first concealed carry bill. And so this is really a response to that movement and our members saying ‘Hey, we need you guys to be the gold standard for training, liability insurance— everything concealed carry.’”

Washington Post Fact Checks Lawmakers On Hearing Protection Act

The Washington Post — in one of its rare reversions to journalism – recently issued a fact check that handed Americans for Responsible Solutions and Sen. Kirsten Gillibrand (D-NY) three Pinocchios for overstating the noise-canceling properties of firearm suppressors. “There is little that’s quiet about a firearm with a silencer, unless one also thinks a jackhammer is quiet,” the report concluded.

California Cancels Gun Regulations

As previously reported, after the California Department of Justice submitted regulations regarding newly classified “assault weapons” to the Office of Administrative Law (“OAL”) for publication in the California Code of Regulations (CCR), NRA and California Rifle & Pistol Association submitted a joint-letter to the DOJ explaining the flaws in the regulations and demanding that the regulations be withdrawn or we would be forced to pursue legal action.

Late on Friday, February 10, the DOJ withdrew the problematic regulations from the OAL’s consideration. It is unclear exactly why the DOJ took this action, however it can be surmised that the NRA-CRPA legal letter likely prompted the move. NRA/CRPA’s letter explains the flaws in both the content and process in which DOJ sought to adopt the submitted regulations. While the regulations have been withdrawn, the underlying statutes remain in effect and new/revised regulations will likely be submitted to OAL in the near future.

Bushmaster Granted Immunity In Newtown Suit

Congress, through the Protection of Lawful Commerce in Arms Act … has broadly prohibited lawsuits “against manufacturers, distributors, dealers, and importers of firearms … for the harm solely caused by the criminal or unlawful use of firearm products … by others when the produced functioned as designed and intended.” … The present case seeks damages for harms … that were caused solely by the criminal misuse of a weapon by [the perpetrator of the Newtown slayings]. Accordingly, this action falls squarely within the broad immunity provided by the PLCAA.

Feds Collecting License Plate Information From Gun Shows

The article states that ICE had hatched a plan to use license plate readers (LPRs) at Southern California gun shows to compare information on vehicles parked at the shows with information on vehicles later crossing the border into Mexico.

Of course, there’s nothing inherently suspicious about attending a gun show or traveling to a neighboring country, even if one event precedes another. 

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

A Carry Gun Is Meant To Be Carried

It was at that point in the discussion when a police detective pointed out that at one homicide scene he’d worked, the dead guy was lying there in his underwear in the doorway of his house where he’d been shot. NRA Fights New ITAR Regulations

In July, we reported on an ill-advised attempt by the Directorate of Defense Trade Controls of DOS (DDTC) to “clarify” who is a regulated firearms “manufacturer” for purposes of the Arms Export Control Act and its implementing rules, the International Traffic in Arms Regulations (ITAR).

As we noted in that report, DDTC’s “guidance” document creates far more confusion than clarity and threatens to chill lawful behavior and put small commercial gunsmiths who cannot afford ITAR’s heavy compliance costs out of business.
