Ninth Circuit Says Anti-Marketing Law Violates First Amendment

A California law ostensibly aimed at restricting the marketing of firearms to minors infringes on the free speech rights of adults, according to a three-judge panel on the Ninth Circuit Court of Appeals. In its ruling handed down on Thursday morning, the panel vacated a lower court decision denying an injunction against the law’s enforcement and delivered a resounding win for both First and Second Amendment advocates.

California Goes All In On Gun Banning

The state Senate on Wednesday approved a measure to amend the U.S. Constitution to spread California gun control mandates coast to coast.
 
The Democrat-controlled body easily passed Senate Joint Resolution 7 in a 24-11 partisan roll call, sending it to the California Assembly for likely concurrence. The measure is the first legislative step to the adoption of a U.S. Constitutional amendment, calling for a rare Convention of States to study the proposal.

ATF Attempting To Stop Private Gun Sales

The Justice Department submitted a new blueprint today to define more clearly who must secure a federal firearms license for legal secondary market transactions. This new framework would redefine who is required to obtain a federal firearms license to sell guns legally. This license mandates that a dealer run background checks on buyers, among other things.

The proposal represents the latest effort by the Biden Administration to strengthen gun control via administrative rules. With the exception of the Bipartisan Safer Communities Act, Biden has not had Congressional support for his gun control agenda. So the President has sought to enact changes through federal rulemaking by the Department of Justice (DOJ) and the Bureau of Alcohol Tobacco and Firearms (ATF).

Judge Scolds ATF For FFL Revocation

In his order, Judge Cogburn had no choice but to rule in favor of the ATF, stating: “Here, the Court finds that no genuine issue of material fact exists as to whether Petitioner violated the GCA. Thus, under Section 923(f)(3), the ATF was authorized to revoke Petitioner’s license.”

“Finally, the Court notes that Mr. Wilson, who sold firearms as a side business, sold the guns to his own stepdaughter. Nothing in the record indicates that Mr. Wilson’s conduct of selling two guns on one occasion to his own stepdaughter affected public safety or hampered the ATF’s ability to reduce violent crime, which is of course one of the purposes of the GCA. Of course, the ATF has been delegated the authority to revoke the license of a licensee who has willfully violated any provision of the GCA, even if the revocation seems a heavy-handed punishment in response to the violation at issue. Still, this sort of heavy-handed exercise of revocations, as opposed to warnings or suspensions, foments antipathy for government agencies,” Judge Cogburn wrote.

Ammo Control Could Affect Youth Shooting Sports

A New York lawmaker is urging the state’s Governor to take a second look at a looming mandatory background check law for ammunition transfers. 

High school trap and clays team coaches, registered with the state as an “Organizational Keeper of Ammunition” for the sake of compliance, received letters earlier this month from the State Police advising them to register with the new NYS NICS office and set up a method of payment for the background check fees – $9 for each firearm transfer and $2.50 for each transfer of ammunition. This is on top of the $.05 per round special excise tax to fund shadowy “gun violence” research plus the 8 percent sales tax on ammo sales that the state already clears.

In fact, as we just heard from one of the involved parties, the judge’s displeasure (probably combined with the fact that Crump was well-represented by very able counsel) was such that Taylor apparently thought better of her clearly unconstitutional, half-baked motion and withdrew it.

Dem Senators Backtrack On Anti-Gun Bill They Voted For

Several Democratic senators up for reelection in 2024 are pushing back against a Biden administration policy rolling back shooting units in physical education classes, even though they all voted for the legislation that made the move possible.

The Education Department confirmed in late July that the Bipartisan Safer Communities Act, passed in 2022, allows it to block federal funding for archery, hunting and gun safety units in physical education classes. The legislation, supported by fifteen Republicans and all 50 Democrats, prohibits federal funding from going to programs that provide “training in the use of a dangerous weapon.” Three Democrats who supported the legislation have since spoken out against the move, which Biden administration told Fox News was required by law.

NDAA Sneaks In More Gun Prohibitions

Section 2(f) of the Undetectable Firearms Act of 1988 (18 U.S.C. 922 note; Public Law 100–649) is amended— (1) by striking ‘‘EFFECTIVE DATE AND SUNSET PROVISION’’ and all that follows through ‘‘This Act and the amendments’’ and inserting the following: ‘‘EFFECTIVE DATE.—This Act and the amendments’’; and (2) by striking paragraph (2).

The provision looks harmless enough at first glance. However, to fully understand how this paragraph further infringes the Second Amendment, one must understand what the 1988 Undetectable Firearms Act says, and why striking the effective date puts our rights in jeopardy.
